Getting a refund for a faulty used car

    Even if you win in court you still need to enforce the judgement which puts you exactly where you are now.

    Get the garage to put in writing that they will refund within 6 days of return of the car, keys and log book. Return the car and if they then fail to refund within the 6 days you can issue a county court money claim for breach of contract which you would win.

    You appear to be on very rocky ground for winning a county court case based on unfit for use given the car did pass an mot before purchase. Front flex pipes often fail spontaneously without looking bad enough to fail an mot. For a lot of cars you can buy replacement flexi sections for around £20 but often the actual full pipe is not much more than this.

    Look, the dealers are not going to refund voluntarily. The 6 day delay is a joke. They have my money they could refund it on exchange.

    I know if the car fails the re-inspection the dealers won't appear in court but will try every trick in the book to not pay a judgement

    If I win at the county court they I know I will have to get some bailiffs to go and recover goods to the value of.

    If there was an easier way I'd take it.
  • Hi, whilst I hate all the do gooders and should have known better posters who have nothing more worthwhile to do with their tiny brains, there is some sense in their somewhere.


    Send a Recorded Delivery Letter to them stating a date and time you will be returning the car, give them 7 days, (thereby giving them an extra day) to have the money ready and waiting. Also make out a form for them to sign and return within the 7 days stating that the car, keys and documents will only be handed over if the cash is available at that time.


    If they don't sign, or, even agree then they were definitely being fishy with the 6 day thing.


    Believe me, you don't want to go down the legal route - I rejected a car and returned it to the dealer at the request of my bank who did a chargeback. They got the money, 6 months ago, but the dealer is pulling all the stunts he can to stop them from returning the money to me. I am now having to go down the ombudsman route against my own bank. Meanwhile I have no car, no keys, etc. and no money!

    Yes with the dealers refusal to give a on exchange I am expecting all kinds of fun and games.

    I will just use the law and eventually I will get my money.

    I sure you know this anyway but you are no doubt aware the inspection by the MOT enforcement people has a cost (same as the MOT) but on the bright side it can be completed at any MOT station so you won't have to transport your dangerous vehicle too far....Good luck.

    There will be no cost to the OP for the test. It passed the last test.

    I returned something to a shop on the high street the other day. The refund didn't go straight into my account.

    Should I take them to court?

    I suspect this is the OP's best option.
