Getting a refund for a faulty used car

    What you seem to want is a car with 12 months MOT and a guarantee that nothing will wear out or break in that period. You seem to be one of the many people who believe that the MOT is some kind of miracle guarantee that a car will be fault-free for the period up to its expiry - but it doesn't work like that.

    The people at Mr Exhaust said the reason the exhaust had come away from the manifold was because the engine mounts were so badly decayed. Two of them need replacing.

    It is true I have no firm evidence the MOT is not genuine. That is why I contacted VOSA (or whatever they are called today)

    It is safely off the road. When VOSA phone me I shall speak to them about getting it to a test station.

    If VOSA say the MOT is kosher I shall have to accept that. I have already sent the dealers a letter by recorded delivery rejecting the car. They have 14 days to offer me a refund (at the time of return not 6 days later) then it is a small claims court I suppose.

    I don't get what you're after. You won't accept a refund within six days but now you're allowing them 14 days after you've returned the car?

    Oh and getting the car there will be down to you.

    They want the keys to the car and the log book then for me to wait 6 days for the money. Obviously I would be a complete fool to agree to that as I wouldn't then have a leg to stand on if they didn't process the refund.

    Under the Consumer Rights act 2015 I have to inform them in writing within 30 days of purchase if I reject the car. They then have 14 days to respond.

    As for how the car gets back to them that will be down to if it is roadworthy or not.

    No I meant getting it to the mot test, you'll be lucky to get it this year and as of now the only evidence you have that the car has a significant fault is the word of a fast fit tyre monkey. Has he given you a written report?

    If it needs recovering to an MOT centre that'll be covered on my breakdown insurance.

    The woman from VOSA was clear that even though it was Christmas I would be contacted within 5 days to arrange an inspection. That inspection may indeed take place after new year but I am in no hurry now I have to resort to the law to get a refund. They have 14 days to respond so I can't apply to the county court until 8th January.

    Initially I have told them I reject the car because of the the badly worn engine mounts, the fact the engine moves so much the exhaust won't stay attached to the manifold and the brakes

    Once the re-inspection has taken place there may be more.
