Getting a refund for a faulty used car

If you read the thread you's see that he is offering a refund but he wants the car and log book back and for me to wait 6 days for the money.
I'd be a fool to take him up on that offer. What if he didn't process the refund, what on earth would I do?
I haven't checked the pads as my word would carry little weight at the county court. That is why I am getting VOSA/DVSA to re-inspect the car.0 -
So you can't be without a car or wait 6 days for a refund but can wait for a court case to be scheduled and heard?
Get the car back to the dealer and get written confirmation that you are being refunded.
In the nicest possible way you have made something simple very complicated.0 -
Take the car back six days later than you planned and the dealer will have your money!

Have you been watching Watchdog too much.
Most men would have checked the brake discs and pads themselves (taking all of 5 minutes), had the exhaust gasket replaced or bolts tightened, and if it was really as unroadworthy as it's been made out, taken it back, argued the toss, left with a cash refund in the pocket and a bit extra for the hassle, and be settling down to some mince pies by now. Not wasting their time calling up vosa hotlines, planning vehicle recoveries, sending legal threats, and posting about it endlessly on mse.0 -
It must be bad if the engine is about to drop out and the brake discs are about to explode at the first application of the brakes, as that is the standard that will generate a MOT refusal, anything above that and it's a pass. Exhaust flexible joints often crack and produce a slight blow, which again is a pass.0

No I couldn't have got a refund. The dealer wanted the car and log book back and I'd have to wait 6 days for the refund and if it didn't come I'd have absolutely no leverage.
If the car passes the retest great I have a roadworthy car. If it fails I'll get a refund enforced by a county court judgement.
