Getting a refund for a faulty used car

    I think once they have the car I would then find it very difficult to get a full refund. I think they want the car so VOSA can't inspect it to see how dodgy the MOT was.

    I don't need the cash to buy a replacement car so if they refuse to refund me at the exchange I will have to resort to the law to enforce my consumer rights I think that'd be through a small claims court.

    But if you do that you'll have to reject the car. So how are you going to do it? You can't reject it then drive home in it.

    Au contraire. The Consumer Rights act 2015 says I can reject the car at any point within 30 days of the purchase. So I could drive it for another week and still reject it.

    But do not worry. The faulty car is safely stored off road. Thank you for your concern.

    Really? Try it then and see what happens in court. ;)

    Should the dealer not refund me then I intend to use the courts. The law may grind slowly but it is on my side.

    But you shouldn't be using the car, it will go against you in court.

    Which is more trustworthy

    A dealer selling second hand cars
    A company selling car parts and repairs
    MOT tester
    Your own eyesight and feel, aided by a torch and a mirror

    That's a good start but rejecting it for wear and tear item won't win it for you in court. ;)

    Scored discs and corroded exhaust on an old used car.... hardly the end of the world. Your lucky they are not arguing it's fair wear and tear considering it's age and mileage.

    Also there's no indication so far the mot is dodgy. Exhaust wasn't leaking at the point it was tested and discs have to be seriously weakened to fail an mot. Scored discs aren't a failure.

    Good luck in court and when they ask why you refused to return the car.

    There's also the question on no advisories on the MOT and seriously worn engine mounts. I imagine once I email VOSA they might want to another MOT garage to examination the vehicle which might unearth other defects.

    I am not refusing to return the car. I just want a refund on return not a 6 working days delay.
