    There's also the question on no advisories on the MOT and seriously worn engine mounts. I imagine once I email VOSA they might want to another MOT garage to examination the vehicle which might unearth other defects.

    I am not refusing to return the car. I just want a refund on return not a 6 working days delay.

    Good luck with that. VOSA closed in 2014. :D

    Really! It's nearly 2017 and when I go to gov.uk it tells me to email;

    csccomplaints@vosa.gsi.gov.uk

    Well spotted. Thanks for the heads up. I will bring this to the attention of the minister Chris Grayling.

    But that was pointed out in #2.

    Please take them to court and let us come and watch you lose. :rotfl:

    From MSE;

    If you buy a new or used car from a dealer and experience problems with it, you have some statutory rights under the Consumer Rights Act 2015.

    The Act states that the car must be “of a satisfactory quality”, “fit for purpose” and “as described”. (For a used car, “satisfactory quality” takes into account the car’s age and mileage.)

    It states that you have a right to reject something faulty, and that you are entitled to a full refund within 30 days of purchase

    If it comes to court I will email you the time and place. If i lose I will buy you a slap-up meal with all the alcohol you want. If i win I expect you will move on and troll another thread.

    Spoke to the people at VOSA. You can appeal an MOT within 28 days.

    They will contact me to arrange a retest with 5 days, they work over Christmas, I will get a report from the retest and should they find the MOT was dodgy I can then use the report in any claim.

    No, you really didn't.

    Scored discs and corroded exhaust on an old used car.... hardly the end of the world. Your lucky they are not arguing it's fair wear and tear considering it's age and mileage.

    Also there's no indication so far the mot is dodgy. Exhaust wasn't leaking at the point it was tested and discs have to be seriously weakened to fail an mot. Scored discs aren't a failure.

    Good luck in court and when they ask why you refused to return the car.

    Lets be honest, Mr Exhaust have applied the old Kwik Fit tactic of getting the car up on a set of ramps and attempting to generate a load of work for themselves.

    My MG ZT v6 has, relatively speaking worn rusty discs and worn exhaust brackets but quite happily passed its MOT and those brakes stop me from some quite obscene speeds.

    I'd say the dealer has concluded "troublemaker" and is refunding to avoid future headaches.

    Seriously - you need to get over yourself here. You've bought an old car with a fresh MOT and have bought in to Mr Exhaust telling you your car "needs" all this work - interestingly work they can do for you! - and put the fear of god into you about it being dangerous. Its an age old tactic.

    The dealer is refunding you and you're still moaning.

    Good luck finding a perfect car with all new, unworn parts for £1500 by the way.

    Mr Exhaust told me it was so bad I shouldn't bother getting it repaired I should just reject the car.

    The dealer is not offering a refund. He wants the car back without ponying up any money. I'd be a fool to give him the keys without payment at the same time. He wouldn't let me drive it away without paying would he!

    I don't want a perfect car for £1500. I want one with 12 months worth of a genuine MOT.
