  • So finally after 4 letters from them they have decided to reply to my 2nd letter.

    Any idea on what to expect now??

    Contents of letter below.

    We refer to your letter dated xx August 2016, the contents of which have been duly noted.
    We have requested, from our client, a copy ofthe PCN, photographs of the vehicle on the date of the
    contravention and copies of the signage located within the Car Park.
    We note Your comments regarding the disclosure of your details as the registered keeper of the
    vehicle by the DVLA. Please find below an extract of the DVLA Release of Information document:
    'The DVLA's vehicle database records details of the registered keeper of a vehicle, although it is
    acknowledge that the registered keeper may not be the driver of the vehicle at any partimlar point in
    time. Vehicle keeper details may be disclose to law enforcentent authorities or private litigants as a
    First point of contact to establish where liability for an incident or event may lie. Refusal to disclose
    these details wouid mean that motorists could drive or park a vehicie without fear of beind held
    responsible for their actions. Disclosure in these circumstances does not breach the Data Protection
    Act and the Information Commissioner's Office is fully aware that data hed on tlte DVLA's records is
    released in this way'
    Our file has been placed on hold awaiting the requested documentation which will be forwarded to
    you upon receipt.

    I expect so as they are all templates with no sign of brain cells engaged. Sorry to ask but, are the spelling mistakes theirs?

  • Not sure most of it was in italics so my phone really struggled converting it. I tried to sort out what i could but only have a phone most of the time to work off so don't see everything that well.
  • I have also received a reply from the SRA who are investigating BW Legal and will get back to me in due course.
  • I got a letter saying thanks for my further evidence. The CSA had a huge wack sent to them too. Ive had to photocopy back to back now to keep postage costs down.
  • Hi Luksakura, what's the latest with your case? I had two letters from BW Legal, one to say pay or else, and another saying the SRA had contacted them and they will get back to me, and it's gone quiet since (that was about a man nth ago).

    Well back here again.

    After BW Legal have had over 8 weeks to respond to my CSA complaint. They have responded with half the information missing, regardingmy response to them.

    They are not upholding my claim as they believe they have not acted discourtiously and still believe there client has a claim.

    I have knocked up a response. But id like to run it through the experts first to see if its reasonable. Please excuse spelling mistakes as im on my phone.


    I am in receipt of your response to my complaint.

    My position is still unchanged from previous responses dated 26th July, 25th August, 26th August and the 5th September. All responses made within 16 days via 1st class post, proof of postage can be supplied.

    I have enclosed copies of proof of payment for the alleged overstay. Payment made in 2 transactions therefore 2 tickets for 1 period of stay. This was enclosed in my last letter and my complaint to the CSA.

    In the case of Elliott v Loake i assume your client is holding forensic details. It would be deemed unfair should this matter go futher that you are with holding evidence. Can copies of this be forwarded to analyse.

    I regard this matter closed, no response in the next 14 days I will assume that you agree and close your files.


    Any advice would be appreciated, as the are really taking the P now.

    As a firm of solicitors, their first duty is to support the interests of justice and the court. Why then are they trotting out E v L despite that case being thrown out as not relevant by courts and despite the fact that keeper liability is only legally possible under Sch4 of the POFA.
