    Should be on page 3. However, depending on your circumstances and what you are complaining about, if you go on the CSA's website and read through their code of practice, you may find points you believe have been breached. It took a while to go through for me, but if you feel the points have been breached, bang em in there and get it sent off to the CSA. The more trouble we can cause for BW with the CSA and SRA (as some people have done and is in the pipeline for me) the better. Not saying BW won't take it further, but they (and others!) should not be allowed to harrass and bully people with their "scary" letters!!

    Do I blind them with science and detail or do I lie quiet and see if they try to issue papers in an incomplete and therefore legally invalid name?

    Research, read, research, read - the forums are awash, near to drowning, with Excel/VCS/BWL threads. Anything that could have been asked has already been asked; anything that could have been answered has already been answered. Look here on MSE over the past 6 weeks, the same over on PePiPoo. Find out where you are on the time continuum and take your lead and action from there.

    This is not a time to ignore anything, do not sleepwalk into a MCOL as those that do seem the most likely to find themselves having to defend themselves in the county court.

    What science do you have available to blind lawyers with? Anything not already covered?

    I am a registered driver for a disabled Motability car owner and she has received a penalty notice from Excel in Stockport PeelCentre for not paying and displaying. As I was pre occupied with seeing to my disabled passenger, I never realised I had to pay. I never left the car except to put her walking stick into the boot and they must have used that opportunity to take a picture. She as Registered Keeper has now received a Penalty Notice deamanding £60 within 14 days rising to £100 thereafter. The date of our supposed infraction was 8/08/16 but she only received the letter on 2/09/16. I have read the Newbie thread but an still undecided as what to do.Any advise would be appreciated. Tel

    Sorry forgot to mention, the Registered Keeper has NOT got a full Driving Licence
  • Luksakura, I have received exactly the same letter as you, they have complete ignored my last letter saying they haven't received communication from me but they did as I sent it recorded delivery! How did you reply, I am just going to send a letter enclosing a copy of my previous letter and the tracking number and ask them politely to respond to my correspondence before sending out yet another harassing letter.

    Complain to the Peel Centre first, telling them this exact situation, written from her point of view (registered keeper disabled passenger who feels horrified at this threat of court & harassment). Offer to pay the Peel Centre £10 or to make a charity donation if they cancel it now, to relieve this stress for a disabled shopper.

    As you have read the NEWBIES thread you will have seen the first advice is to complain to the landowner and there is a hyperlink to example successes, called 'Successful Complaints about PPCs' which has Excel wins in post #2 of that thread. Includes at least one thread example with the Peel Centre Manager's email address.

    The picture was taken by ANPR camera as you drove in and out, not by a person.

    Also send a challenge in her name to Excel, mentioning she was not driving, has no full driving licence and is disabled...blah blah (not saying who was driving). In this case I would NOT send the template appeal, I would tell it like it is, without naming the driver.

    If you want to protect her from future letters, write as her, in her name not yours, but tell them she 'has a new address' and give YOURS. That way, you will know if they reject the complaint and appeal and she will not be worried. You'll also see all subsequent letters first. She is not liable, as a keeper who was not driving. DO NOT name the driver.

    Why are you sending letters recorded delivery? No-one suggests you even expend a single stamp on these cases, certainly NOT recorded delivery (did you check if they even signed for it - parking companies sometimes refuse...). Email is best, being immediate and free.

  • Thanks Coupon-mad, Legal Beagles have said exactly the same thing! They did sign and I have a copy of the signature. I have just emailed them.
    It seems I'm just getting threading letters with promises of court which isn't happening, would that be because my parking fine is 2011?

    No, they have certainly filed a number of 2011 claims that we've seen on pepipoo forum. If you have not yet put in CSA and SRA complaints as per the examples in LoveNorfolk's thread, doing that stops them in their tracks for at least a month and could have repercussions for them (and it makes no difference to you). Make sure they are strong complaints like the examples in that thread.
