    It's not as simple as it first appears. An agent holds an ATOL licence, but the licence only covers them going bust, not anyone else. To be covered for anyone else going bust you need an insurance policy that can either cover the original amount or the increased amount it could cost. I can't remember the exact figure I read, but ATOL agents with insurance to cover this is low. In essence, all ATOL cover is not equal, and there is no way of telling.

    Lastminute have not been helpful or nice about this situation as far as I can tell from the forum, the only way to get a refund is to do a section 75 or chargeback claim on the card you paid with, Lastminute seem to not want to know.

    Turns out the hotel booking was farmed out to Jumbotours but not been paid so have just repaid it and awaiting money back from Lloyds

    Only found this out about Jumbo as have just come back from the same resort so we nipped round to his hotel to check
    Would presume Jumbo never contacted my lad about the booking because they wouldnt have any contact details apart from name
    That's exactly right. I booked with lch and they booked with jumbo tours. I contacted jumbo tours who would still allow the booking but wanted full payment by credit card which I didn't have . Also as you booked via jumbo tours you are no longer atol or abta protected as they are located in Spain
  • I paid through PayPal and had claimed the whole amount of 1400 odd but had an email off them saying they have decided in my favour but will be refunding 600 odd quid which was the cost of my hotels and it's gone straight onto my card.

    What date did you start ur claim. And can you tell me what you've been doing to get ur refund. Have u been messaging them Dailey ringing them constantly emailing them etc

    Oh no, we are at the mercy of randomness!

    Thanks for letting us know, and also that they are just doing the hotel part as I was worried about losing my flights having rebooked everything else.

  • Well i've just got off the phone with Barclays and its looking like im going to be refunded the total of £2245 for hotel and transfers in the next 2 weeks. They said that the case has been investigated and its been awarded in my favour. I started the claim on the 18th july so there's hope for everyone still in limbo.
    I paid on a debit card in March and thought I'd lost the lot!!
    Hopefully it will be in my account before we go on Monday as we have to pay for the hotel again which was going to be paid on a credit card!!
    All I need now is HSBC to pay out the other £1000 on another debit card I used to pay for the holiday.
    Hope everyone gets sorted and paid out, and if I ever meet that paul evans itll be a day to remember #hospitalfoodforlife
