If he claimed off the TP insurance then the terms of his own policy become irrelevant.
That's what im meaning, I had the same thing with my van 18 months ago, TP insurer offered a replacement van for as long as was needed, was no good for me as I couldn't work because of injuries I sustained in the accident. My understanding is that TP insurer pays for a courtesy vehicle until they make the payment for your loss.

Just an update on this for you all, I got a phone call from our MP's assistant on Thursday asking if we heard anything from dvla, she told us to wait a few more days and contact her again with any news, which was nice to hear.
A letter of apology has arrived this lunchtime, in it, it states that the fault was down to human error after checking the photographic evidence even though I've asked 2 people there did they have photos and was told that they didn't. So now I just want to get back my costs from them.
