The CPS have obviously decided it's not in the public interest due to her mental health. So you advise that the OP now instructs a solicitor and pays for her to be prosecuted. If a private prosecution was started, the CPS would step in and discontinue proceedings, the defendant's solicitor would not even have to approach them for this to happen.
You could start a claim in the small claims court to recover the costs of the excess, but it is likely that the defendants mental health would be put forward as a defence, and whether or not it would be accepted would be down to a district judge.0 -
Am at the police station now. Was on holiday and came back to see my cars tyres with screws in.
GUess what CcTV shows- my neighbour ducking next to the afected tyres (front right and rear right).
same size and type fo screw taken out.
Police officer denied to take report stating that there is no point as she has Alzheimers (and yes, he disclosed her ilness) and wouldnt go to CPS and would just be a waste of public funds. He advised to contact the local MP.0 -
