Help Needed regarding APNR ltd appeal
Comments
-
Okay so it starts off with an awfully formatted invoice for £100, with reference to 'Debt recovery costs: appeals process, invoice production and correspondence - £40', 'County Court Summons: Preparing and gathering evidence, setting out case and filing - £70' and 'Judgement Enforcement Officers fees per visit, per hour - £135'. Then states total amount payable to be £100.
The letter then goes on to say...
A 'my car details' with the licence plat number ____, which is registered/hired to you, was parked in direct contravention to this company's wishes, therefore we have on the 25/08/2015 at 13:30:00 in area known to us as Bovey Court, issued a Parking Charge Notice, Reference No: ___ for damages incurred whilst the driver trespassed on land under our control. The incident was photographed and is now considered evidence and can be used in a court of law. Having chosen to ignore/waiver/forfeit your early settlement offer of a 50% discount it has left this company with reasonable cause to use the details from your appeal. The action has now incurred appeal and debt recovery costs leading to the damages rising to £140. According to our code of practice, this fee can only be charged after 42 days has lapsed from the date of issue or date of appeal but your opportunity to pay the £100 is diminishing fast. Should you fail to act, we have no hesitation to hand this debt to a 3rd part.

LOL, they don't have a Code of Practice!
It's the same Final Demand they've always used with hardly a change to the wording from 2013. Not much imagination, Trev's lot!

Post #43 there from 2013 shows it under the famous 'N Martin' rejection 'I know every car park personally' letter.
Here it is again in 2015 as shown by the BMPA:

Yeah I'm going to ignore this.
No doubt something more threatening will come my way...
Can they actually do anything regarding court etc?0 -
yes they can "attempt" court , however after the "untruths they have told , they would look fools in court
Should you fail to act, we have no hesitation to hand this debt to a 3rd part.
PS: a third party cannot attempt court , unless the debt is actually assigned to themSave a Rachael

In which case the person owing the alleged debt must also be informed of this assignment ... there are specific legal steps that must be taken. Check out the Prankster's blog for Champerty and Maintenance.0 -
Another letter has arrived! This time titled final demand with red font and demanding £140 now.
Wording is exactly the same as the previous letter.
Thoughts?0 -
