    UPDATE:

Any advice on what to do next?

    Dear ANPR,

Any debt is denied. Damages for the tort of trespass must equal the loss to the land occupier. I refer you to the case of ParkingEye v Beavis and also Ransomes Park v Anderson.

Debt collection activities are therefore not appropriate and will be wasted costs.

I am open to alternative dispute resolution. Please propose an ADR Entity you think appropriate. Otherwise, please supply me with the information required by resolution 19 of The Alternative Dispute Resolution for Consumer Disputes (Competent Authorities and Information) Regulations 2015.

If instead you wish to use legal action, please follow the pre-action protocols and send me a letter which allows me to understand your claim.

    As above, but add -
    Otherwise, FRO!
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

So after calling the letting agency with whom I arranged a viewing with, they have replied sheepishly with this email:

"As the marketing agent for an individual dwelling, we act in line with our instructing client and duly seek to secure a suitable tenancy for their property. Neither our agency nor our private individual client control or impose any parking type restrictions at this or indeed any other site, and as such and whilst we do sympathise with the situation you find yourself in, neither our agency nor our private client are in any position to take any further action in this regard.

By way of information and which may assist you, it is our understanding that the freeholder/management company for the development is RMG Property Management, and it may be that it is this company who have a contract with a third party to impose parking controls on the site and who may be able to assist further should you wish to raise this matter with them.

If we can assist with regards to any ongoing property search, please duly advise, where we remain happy to look to assist in any continued efforts to secure a suitable rental property for you and your friend."

Disappointed with this not to say the least.

EDIT: Time I get onto the property management group now!

did you speak to the actual property owner ? having a quick search on the web shows that this company impose parking (and make money) without informing the property owners , and amending there leases
