    I've forwarded a couple of mail chains to the address you put on the poster. If you've not got that anymore PM me another email and I'll send there.
  • I've emailed my MA and told them I'm opting out of the permit scheme due to be way this episode has been handled. I've stated about the space being in the deeds to my apartment and that there is no requirement in the leasehold agreement to display a permit.

    I mentioned about trespassing and that I didn't want to display a permit as this could give the parking company "implied access" to my space which could void the trespassing argument and leave me open to more tickets due to "admin" errors like this one.

    The MA person for my complex gave a brief reply that my comments had been duly noted and it had been referred to their legal department.

    Has anyone got any idea as to what they may come back with? I'm not legally trained so no idea what I'm getting into here!

    Does it matter? The law is the law, and, whatever they say, only the law, contract, tort, trespass, harassment, Housing Acts, is of any consequence.
    You never know how far you can go until you go too far.

    They'll come back with a load of old rubbish that hopes you don't know any better. It'll be in their financial interest to maintain this scam, as they are probably on a backhander for each ticket.

    They would have to vary the terms of your lease. That requires consent by both parties, so they won't get yours. Game over.

    I don't think they can do anything other than cancel your tickets. The only other thing they might have a go at is to change the Ts & Cs of your lease to include the requirement to display a permit, but I would imagine that you would have to give your consent for that. They might just change it so that it would apply on a rolling basis as old tenants leave the property and new ones take up the lease, but again, I think you are home and dry on this one.

    a. They can't change an existing lease without agreement
    b. They are unlikely to even ask as it would cost a fortune in solicitors fess to THEM to make any changes across all leases.

    Generally Managing Agents are failed Estate Agents so bottom of the scum pile. The posters in this thread who own their flats should be looking to force a sale of the freehold - then you can dispense with the MA and not even have to replace them.

    They don't need to buy the freehold in order to exercise their right to manage.

  • I've recently found out the tickets aren't even actually cancelled yet despite someone at the MA saying they had been. Instead they are liaising with VCS. Been informed the VCS Operations Manager was having a meeting with the VCS MD about it haha!

    I still expect them to be cancelled. MA has subsequently said they have a list of tickets to be cancelled.

    As a sidenote, the person who manages my complex has left the MA. Maybe they didn't like the way they were operating either!

    My main issues regarding VCS and the permit scheme and trespass etc have not been responded to. No input from the Lease Compliance Manager.

    I have received my new permit but not displaying it.

    PS Thanks for the last few posts of advice always appreciated.

    I got a notice to keeper/driver today too for one out of the two tickets I received, even though I appealed the original and haven't heard anything back from them about that since.

    The notice they've sent has all the stuff about appealing within 21 days and paying within 28 days. Is that in relation to the original PCN on the vehicle or the notice to keeper they've sent through?

    The whole thing's a joke.

    The "experts":rotfl::rotfl:here will say ignore once it gets to the debt collectors stage and read the newbies stickies--- but we are all fallible and if you were given bad advice by a professional you could sue, but if you are given bad advice from here you are left to bare the brunt (what ever that might be), your an adult you read the advice and choose the best course of action, and then all the "experts":rotfl::rotfl:can post about it and increase their post counts.
