Hello, i too live in the same apartment block. Saw the letter on the wall, sent an email and no reply. I got one parking fine, issued just before 8am the morning the new permits went live. The ticket officer was there when i got to my car at 8am. Had a chat with her and she told me 'they had been informed by the management company to be at the car park to issue cars without valid permits a ticket' (i obviously dont have proof of this now) but the management company have emailed me saying this wasnt the case.
I have appealed my ticket and WILL NOT be paying. I also complained to the management company and asked for something to be done.
Im glad we are all sticking to our guns by not paying but i expect to receive a rejection email from VCS about my appeal. Just need to work on the next stage. It really annoys me the way these scammers make money.
The best thing was, when they were handing out the tickets, the ticket officer was parked in another residents parking space, surely that should be ticketed! GRRRR!!

Interesting that the VCS employee claimed the MA had told them to be there and also that the MA deny this! Surely the MA can't be happy about VCS making them out to be the bad guys and will deal with it appropriately! Unless the VCS was person telling the truth......

Thanks for that letter template Half_Way could come in handy.

So your management company think their agent's signs trump your tenancy agreement?

Yet another reason why you should be looking to sling these incompetents out.

As is the case with our management company. I am sure they have a vested interest.

But then I remember something about PPC's also being interested in property management. Human greed at its finest. Ours (Chamonix) fleece us for £2000 a year and we get sweet FA in return.

We have plans to move out soon.

I should really start my own PPC and property management company.

  • Hi, I am yet another affected resident although I was luckily only ticketed once. I have been in contact with them many times and have chased again today and thought I'd update you all on what they said.

From all of the calls they have received they clearly know what is up and they gave me the same spiel about royal mail although the letter we have seem to prove it's Trinity Estates fault. That aside, they said that if I sent them my PCN details that they would get the notice rescinded. They also said that this is true for all of block C. So if you want to follow my lead, you have to email them the information as they need it in writing. The woman I spoke to was Amanda Morris and she was actually quite helpful. I suggest you ring and confirm with her and then send her the email right away so that it's doesn't get forgotten about. I also asked in the email if I should still appeal it myself and will tell you the outcome when she replies.

It's been really useful reading the thread here so thank you everyone.

Once this is sorted you should get the MA to dump this useless company, their role is to make life easier for residents, not more difficult.

    Take them to the Tribunal

    Thanks for the info James.

Maybe their attitude has changed slightly as I spoke to Amanda before and she wasn't much use. They need to shut up about Royal Mail now it's very boring. We have proof the problem wasn't caused by them an even if it was it's really not the issue here.

I will mail Amanda and Simon myself regarding what you said as if it's true then good but if it is true why have they not informed all the people who have been in contact with all the affected residents to inform them of this policy???

I'm not sure which block I'm in, which is Block C?
  • So seems we've won! MA are telling VCS to cancel the tickets. I'm going to wait for confirmation that they've been cancelled then I'll be emailing MA and VCS. Think I'll tell them I'm opting out of their permit scheme as not having this again. Guess it's maybe different for people who rent. Up to the landlords rather than the tenant to opt in or out. MA is still blaming Royal Mail though!

Cheers for the input on this thread everyone love u all! 😉

    @JBak

Block C is the smaller 4 storey block stood back from Cherry Street (not the big glass fronted L shape blocks running along Bramall Lane and Cherry St).

Don't suppose you could copy and paste the correspondence leading up to them saying they'll cancel them could you? Or send it in a pm on here?

I'm not in block C, that's the only problem. Sent of a long appeal / rant to VCS tonight as I got absolutely no where with the MA and my letting agent is being as useful as ever.
  • A point here for anyone in this particular situation:

The parking space is demised to you if
    • you are an owner whose deeds specify use of a parking space
    • you are a tenant whose tenancy specifies that you have use of the parking space demised to the owner
If the parking space is demised to you, then your rights to use the space are only subject to the deeds for the property - and as modified by your tenancy agreement if you are a tenant.

If the parking space is demised to you, then the guff about fines or increased fines if you do not pay by a certain date do not apply. After it has been pointed out to the parking outfit that your right to park there is absolute, any further demands from them amount to harassment.

If you are taken to court, relish the prospect. You will need to wave your deeds or the deeds and a tenancy agreement at the judge and [if the judge is half awake], the case should be dismissed with costs in your favour.

Bear in mind that this situation is entirely different legally from the majority of cases on this forum where people are being done for parking on someone else's land. Here, we are talking about parking on your own land - even if you are a tenant, if it is specified in the tenancy agreement, it is your land.

In such situations, you do not need to appeal or feel anxious about the process. There is no obligation on you to comply with any of the parking outfit's processes whatsoever. You just need to tell them the once to get off of your land.

[I begin to feel that something on this issue should be added to the stickies]

Furthermore, by entering your parking space to stick their stupid tickets on your car they are trespassing.
