Hi everybody, I've received a pcn from VCS for allegedly stopping (less than 10 seconds) on one of their managed roads, for which I'm preparing to send a letter of appeal against the charge and will be using the template on here created by Coupon Mad.
From reading (for the last 5 hours) the newbie section I take it that I do not mention the specific circumstances of my defence and always word it in the 'third person'. I obviously don't expect them to uphold my appeal but do expect them to offer me the opportunity to appeal to the IAS. I take it that I should decline the offer ?
Should I be telling your good selves the circ's of the incident in this thread or is it deemed superfluous and not of interest ?
I would like to hear from anyone who has been successful with an appeal at Liverpool JLA as it seems a minefield for vehicles parking there.

Forgot to mention - should all correspondence to them be by letter or is e-mail acceptable. If so, does anyone have the e-mail address as none is shown on their letter.

no interest at all, plenty of threads on here about JLA and a big parking prankster blog on his site about it not long ago too
your initial VCS appeal will fail, chances are any IAS appeal will also fail
in which case its ignore the letters for 6 years, apart from an LBC or MCOL from VCS
very few PPC`s allow email appeals
follow the instructions on their pcn, or their website
if using royal mail, get a free cert of posting at the P.O.
DO NOT NAME THE DRIVER, or infer who it is0 -

IFAIK no one has won a IPA against the VCS at Liverpool .... but searching the threads will so some one did win an appeal against them else where ... Humberside ????
The scammers that infest JLA are in cahoots with said airport as its is a (allegedly) mutual financial arrangement ....
Go back a year or so and you would win this at a POPLA appeal ..... however in the world of PPC's they can create another appeals body (the IPC) that are a (again allegedly) kangaroo court :eek: (the IPA)
you therefore can (after reading the below) chose to wait it out , or in IMHO do the appeals as a paper trail.
VCS did try out their first small claims court case over such .... I predict that they will pull out before the trial ..... and ---they did pull the case with a week to go .... wonder why?

If the PPC does not use POFA then there is no liability for the RK to name the driver.
Now the IAS will "presume" that theRK was the driver, but if the RK was the one being dropped off and even better if they could prove that they were the passenger using the airport, then it would be worth including that point in the IAS appeal. No doubt they would still choose to assume what they wanted but should that ever get to court, then I would love to read the words of the judge who heard the case.
The IAS are not an honourable organisation in my view. But I would still go through the motions as you have little except a few minutes and a stamp to lose. The PPC has to pay for the appeal and if it ever got to court, then you have the brownie points for having gone through the IDR channel.0 -

This probably would have been my response, unfortunately the vehicle is registered to my 'other' address which i own, (I live at my partners address) so was waiting for my VEL reminder for the beginning of July prior to changing the registration document. I feel that if I don't respond and allow them to keep sending correspondence to my other address I may miss an important letter - such as court proceedings etc. So, I do intend to 'play ball' and go through the motions just to show that I'm not being the unreasonable one. I will place my home address on the letter and also let dvla know as well. However, if they fail to notice the change of address and continue to send letters to the old one, well, that's their fault, not mine..
One other question, I could do with going back to the airport to take pictures of the signage - but there are restrictions on where foot passengers can walk (a relative of mine was told off for taking the wrong route back to the car park). Plus you are only allowed 20 mins on the free park and can't return within 6 or 8 hours. So will I be allowed to gather evidence for my defence or be escorted off the premises ?

Thanks RedX, I'll have a look for them. It's the ones directing me to the free car park that I'm mostly interested in. Just been looking on Google Earth which was updated 04/15 so should be relevant to my cause. The map on the JLA website takes you on a route through a 'No Entry' sign and the actual road to the car park isn't even shown on the map. Oh, the joys of motoring !0

I am writing to you as I am the registered keeper of vehicle registration number xxxxxx and I was sent a parking ticket from yourselves.
I believe that your charge is punitive and unenforceable and I am appealing on a number of different reasons to be listed below:- I pulled into the space briefly to consult my map/ iphone map to find the hotel that I was staying at that night. You will perceive that the alleged offence occurred at 10.00 pm after 4 hours driving and I was not able to find the Holiday Inn Express Hotel first time. I was alarmed by the sight of the airport roundabout ahead and wanted to consult a map to check where I needed to go. I moved on speedily when prompted by your helpful parking officer who gave me the correct directions. I was in the spot around 3 minutes. Given that I have documents/ receipts to prove that I stayed in a single hotel room in a Hotel that offers free resident parking that night and I was not picking up or attending the airport, I maintain that the landowner suffered no loss from this incident. I was not seeking to evade the parking charges in the use of this private land.
- I challenge the assertion that your parking charge represent a genuine pre-estimate of loss to yourself or the landowner.
- I maintain that I sought to minimise danger and disruption around the airport by clarifying where I was trying to get to, avoiding stopping on the road itself, and avoiding driving while simultaneously map reading, which goes against the Highway Code.
If VCS refuse to cancel this 'ticket' then I invite you to reply to me stating your reasons and giving me a POPLA code.

except VCS "dont do" POPLA anymore, and havent done for about 9 months or so
its the IAS now, via the IPC
otherwise I agree an appeal can possibly get a cancellation, but not very often as they ike the money too much
