Smoking in a rented property

    I know a few ex smokers, and I can tell you that smokers are the masters of denial. In addition, some of them are also very selfish, and think it's their 'right' to smoke. It is not. And why anyone would want to smoke in their own home just eludes me, and I literally think people who smoke in their home with CHILDREN in there, deserve to have the children taken away. I know a number of people who smoked years ago, and their children have got (or have had) conditions that are or were related to their parents smoking in the house.

    And people wanting to smoke in a rental property when they are told explicitly that they cannot, is very wrong. I would have them out ASAP if I were the landlord.

    And I have to take issue with the poster who is insisting her husband has absolutely no smell of smoke on him - ever. He even smokes in the house too, and she is still denying that he and the house stink of smoke! I don't believe for a split millisecond that he doesn't stink to high heaven of smoke. This poster must have been brainwashed or conditioned to believe she cannot smell it. Either that, or she has ZERO sense of smell, because no way in a million years does that man not smell of smoke, and she can deny it til she is blue in the face: nobody believes her.

    Also, she says that she would never ask him to not smoke in his 'own home,' but any kind of a decent person would not need to be asked to leave the house to have a cigarette, they would just do it. It's incredibly selfish of him to not leave the house to have a cigarette. I sincerely hope he never smoked around any children!

    Some smokers are very selfish and self-centred (NOT ALL - SOME!) and they are constantly in denial about how much they stink like a rotten old wheelie bin, and how their house reeks. I literally only have to be around someone smoking outside for 30 seconds, and I stink of it for hours! So to try and say that smokers don't stink of it is just laughable. I can't believe anyone would expect people to believe it.

    Also, we have moved into houses several times in the past that belonged to smokers, and it took about a MONTH each time for the smell to go: the nicotine sticks to everything, the walls and ceilings are yellow, the curtains stink, the wallpaper stinks: it's utterly vile. If a smoker inhabits a property for a length of time, the place will need decorating throughout for sure when they leave.

    And why can't the OP just go outside?! So they need to go downstairs and outside? Tough. And to do it in someone else's property when it states you cannot smoke, is pretty disgusting. I would have you out in the blink of an eye if I were the landlord.

    In fact you are incorrect, it is a right for a person to smoke. Where they can smoke is the debateable issue.

    Can they smoke in rented property - yes.
    Can they be held liable for any damage - yes.

    There you have it.

    If a prospective tenant indicates to the landlord that he is a smoker and the landlord accepts to let the property without mentioning anything about smoking then IMHO any 'damage' should be fair wear and tear.

    Now, if the tenancy agreement states that the tenant may not smoke in the property then arguably the tenant is not allowed to and will be liable for any 'damage'.

    There's a colleague at work who smokes in her home, and when she takes documents home with her they come back absolutely stinking to high heaven. If you pick the document up, your hands stink all day, and you have to scrub multiple times to get the taint off. If that's what a piece of paper being in a smoker's house for a day does, I hate to think of what the smoking does to appliances/furniture!
