    I think that's a question the OP can answer. I imagine 'be unpleasant' would be a severe underestimation...

    More unpleasant than the potential consequences of running her credit or worse, being accused of fraud? One is protected, the other one isn't, I know which unpleasantness I would rather deal with. The more unpleasant he gets, the more ammunition she has to make sure he stays away from her for good.

    Just out of curiosity, what does it say on the Electoral roll? If you have single person Council Tax, then surely it shows he is not registered as living there? In that case, it would be right to say he doesn't live there.


    Note: I am not saying he isnt 'entitled' to live there as per the tenancy agreement, just questioning where he appears on the Electoral Roll.

    We did a council house swap, my name has been on the tenancy only for every house.. Just could kick myself in him coming to sign for this one. He is on the electoral roll here. I know legally he is entitled to live here. he knows this too and uses it as bullying tactics. He said he will keep his name on the tenancy for years just because he can.

    I don't know how it all works as I am on a single person council tax, its just so frustrating as if it was a private let there would be no problem with taking his name off.

    I presume, then, it's a secure tenancy. You don't often get those in the private rental sector.

    Does seem daft that his name should remain on the tenancy until HE decides not to (or until you can get a court order). That's one of the few downsides to having a secure tenancy, I suppose. Really they're there to protect the tenant, which is good, except in cases like this one where he's obviously playing the system.

    By the way there might be more information if you post over on the housing board, if you want to know more about getting him off the tenancy?

    Again save you the time.

    Only a court or both parties agreeing can do this.

    That means both tenants and the council will need to agree to the change!

    Dunno who told you that, but the procedure would be identical in private rental.

    Like I said, if it was a private rental it's very unlikely to be a secure tenancy.

    Agreed.

    But it would still require consent or court order to change the tenancy.

    Especially if in fixed term. Outside of that, it would be easier. As either tenant can end the tenancy.
