He can literally move back in today. So how about we stop the wishful thinking which will give the OP false hope?!

That is incorrect, - he has been given some sort of court order banning him from going anywhere near the place! He cannot even enter the property let alone move back in.

That said, I suspect it might be in the OPs interest to 'keep him sweet' until he moves into his other property, after which, hopefully she'll be rid of him. You can't own a property and take up social housing at the same time!

Did you miss the part that WA will assist the OP in getting legal support to keep herself safe ? That includes ensuring he can't move back in.

I'll save her the phone call - OP Find a legal aid solicitor and hope their case load isn't high.

I gleaned it mainly from post 5 but also from other posts on the first page. There's been police intervention, and he's not allowed back to the property is what I understand from it.

I am not sure why you choose to post in such an aggressive tone.. maybe the situation strikes a chord with you?

Why not just cross out your address and write his current (actual)address on it, then stick it back in the post. That way he still gets it to where he's ACTUALLY living, and the issue of return to sender is gone.

    But also Guest101...

    The police are not morons.

We don't know whether the OPs OH got charged or not, just that in her words there is a lot going on that she doesn't want to go in to. He could be awaiting trial for all we know, but that is pure speculation.

OP, hope it gets sorted for you.

Yup, we've had a problem (aggressive) tenant here where I live and believe me the Police know him.. They will have had plenty of experience of dealing with aggressive council tenants.

His name can only be removed from the tenancy if he agrees, or if a court orders it. If he agrees, then he would be considered to have made himself intentionally homeless, so he may well have been advised not to do that.

If you apply for a court order the test the court applies is to consider whether the harm caused to him by taking him off the tenancy will be greater than the harm caused to you by refusing to remove him. If he has suitable accommodation with his family, and there is a history of domestic abuse, and you have a child, then it is very probable that the court will order that the tenancy is transferred.

You may be entitled to legal aid if you have evidence of the domestic abuse (the police reports should be sufficient)

Neither the police nor the council, nor anyone else, has the power to take him off the tenancy without his consent.

The only way round it without a court order wou be if you could arrange a transfer with another tenant, as that would involve the surrender f the existing tenancy and the creation of a new one, but unless you can find someone else in the area you want to stay in, who wants to swap, that isn't an option.

There is nothing to stop him being on 2 tenancies at a time. He can't have 2 council tenancies, and he might have trouble claiming housing benefit if he is on a tenancy for which HB is being claimed, but there would be nothing stopping him signing a new tenancy.

Ypu might eb able to negotiation with him that you will agree to the paperwork coming to your address if he signs a (postdated?) form to come off the tenancy.

Otherwise do as Vikipollard says - cross out your address, write in his mum's and put the envelope back in the post It will get to him and you don't have to meet him.
All posts are my personal opinion, not formal advice Always get proper, professional advice (particularly about anything legal!)

Why are you so keen that the OP doesn't get emotional support ? Your behaviour is really odd on this thread. I suspect there's something more going on here with you - but please stop.

The police saying he can't come is not a court order. In fact it's fairly meaningless.

    Accurate, rather than aggressive.

    I'm putting practical over emotional.

People are getting things wrong - as I pointed out. The OP needs facts in my opinion.
