Ex wants loan in my address

    I just don't know what to do. Obviously I'll leave the tenancy issue as my original issue is of him getting this loan, he said he will apply for it and as soon as he has moved he will change the address on the loan.

    He said he will take his name off the tenancy as he will have to (he can't have his name on a council house and another house) - My huge issue is with the fact he is a compulsive liar and a gambler.. Obv I want him to move on and part of that is him getting his own place etc.. but he can't be trusted.

    Don't know who told you that, but he can have his name on multiple properties.

    Nobody knows the circumstances surrounding OP and her ex so I don't think suggesting she sends the papers back or loses them is the best advice here - if she does that, it is her that deals with the fall out, none of us. OP, only you know what would happen if he never gets the papers, if you feel OK with doing that then by all means try to delay it/stop it happening.

    Otherwise, I would concentrate more on getting his name off of your tenancy, using any means possible. If he did take out a loan at the address (which it seems he is entitled to do, with being on the tenancy?) then the worst that could happen is a knock at the door one day which you only need respond to with "sorry, he moved out months ago".

    Though as already mentioned, if he is still using your address and you are in receipt of any benefits - this could cause problems for you.

    No they can't- but what they can do is give the OP both emotional support and the legal wherewithall to keep the OP safe and not be subjected to this man's ridiculous demands.

    The OP has already said she is scared of him - and it really doesn't help her to pretend there aren't ways to help her and keep her safe the way your post implied. There are legal ways to deal with all of this - so your nonsense about false hope is simply spiteful and nasty. I wonder why you post in that way.............

    I posted facts. I didn't say there wasn't hope. I said she was asking the wrong people. - it was already said she needs a court order. Can you guess where you get one of those?!

    It would appear the police have been involved at some point and that fact coupled with the fact that the OP has experienced domestic abuse, evidenced by the fact she's frightened of him and what he could do, and telling her to commit fraud by indicating he lives at the address when he doesn't - evidenced by her being given single person CT discount - will give the local Women's Aid plenty of ammunition to give her to fire at the council to get the man removed from the tenancy.

    Omg?!

    Was he charged and convicted - no.
    She says she's scared- is this evidence in court - no.
    She's sole occupier - not fraud.
    He's not committing fraud either, he has a right to live there.
    Can the council change the tenancy- NO. YOU NEED A COURT ORDER.

    So there you go, wishful thinking...

    And what will he do if she writes 'returning to sender as doesn't live at that address any longer', which IS correct. He might be able to live there again, but he isn't currently doing so.

    I think that's a question the OP can answer. I imagine 'be unpleasant' would be a severe underestimation...

    Did you miss the part that WA will assist the OP in getting legal support to keep herself safe ? That includes ensuring he can't move back in.
