They turned this down flat, saying it was not miss-sold. Whilst we were arguing the case, it went past the six year deadline for court, so i filled out the FOS form.
The FOS wrote to them asking them to look again at the case, and they backed down.
Make sure you don't miss the 6 month deadline for referring it to the FOS though (after the Halifax send their final response OR advise you to take that route)0 -
Any idea what the average time it takes to go through the FOS. They have my PPI claim against the HSBC since March this year and I've had 3 letters back saying they are still waiting to assign it to someone. I sent my 1st letter in Nov 07 then 2nd in January. Both were declined, so went to the FOS.
Still waiting ......
Will all be worth it if they repay it back. Fingers crossed
HSBC have been paying out, so hopefully you have a good case. Surprised mine only took 6 weeks though, as you have clearly been waiting longer.
Don't forget, there are many reasons for miss-selling. Inform the FOS of anything that might go in your favour, eg not working, self employment, not recieving forms and notice of cancellation rights, not being asked about health etc at the point of sale (most policies are not valid for anyone with mental health probelms, heart problems etc).
I kept sending new reasons to the FOS, stating why i believed the policy was miss-sold, after seeing articles on TV. This may have prompted the FOS to assign the case a bit quicker.0 -
The Halifax have agreed to pay back all PPI on a credit card going back to February 2002, after just 6 weeks with the FOS. 8% Interest will be added, as will the interest they have charged on the payments, totalling over £4000.
Well done!:money: (I'm so wishing I went the FOS route than the court route with them now!)
Interesting that HBOS are making these payouts when they've told me that Halifax Insurance Ireland are the party responsible for insurance on their credit cards, yet they'e making offers to settle to people! (While also denying that HII are part of the HBOS Group!).
My frustration and anger are building, but everytime I hear of someone settling with them, I feel somewhat happier and more optimistic.Almost debt-free, but certainly even with the Banks!0 -
Halifax have finally agreed to pay us and issue a new amended loan.
Just have to see how long it takes for them to refund us

Hi,
At the end of last year, I wrote to Halifax on behalf of my partner to complain about the Mis-sold PPI.
Basically, he thought that if he took out PPI, then it will get him more of a chance of having a loan.
I had already had arranged insurance for my partner for Ant Insurance, so I didn't see the need for this, so I arranged to go get it cancelled, when I had discovered he had the PPI- in November last year.
To cancel PPI, Halifax explained we had to take out a new loan, with no PPI, to pay off the old loan.
We went to the branch to do this, and the new loan was declined-
So I wrote a complaint.
They wrote back on Dec 13th to decline my complaint.
Since I was doing my dissertation at the time, and we were arranging to move house etc etc, I just left it at that. (Unfotunatly my partner is not one to complain, or write letters, so I couldn't leave it in his hands).
Now that we are settled into new house, I saw that some people mentioned that banks tend to decline the first letter of complaint- so now I would like to carry the complaint on. But we are out of the 6 month deadline to put forward to FOS.
Would it be worth me sending Halifax another letter of complaint?
(we have managed- just last month- to get the PPI cancelled at the bank.
The original sales person said she couldn't understand why we were denied the first time, and that she'd get back to us, but she didn't- and it really sucks that to get things sorted, the customer has to be SO on top of things- which is hard when I'm trying to sort out my own things as well as partners!! lol)
Any advice will be greatly appreciated!!!0 -
Just come to the end of 3months of effort withWelcome Financial services,they sold my son a loan of £4120 and when after 6months, I tried to pay it. off they came up with a figure WELL in excess of £5000. I refused to pay and asked for a breakdown of the sum only to find they were charging him £1100 PPI, something he knew nothing about. At this stage I must say my son was in a mess financially. We kept on at them and I contacted the ombudsman,using the letter template from this site, and today Welcome have visited me and accepted payment for a 9month old loan of £4120!!1
Keep away from Welcome Financial Services if you are looking for a fair deal and to be treated respectfully. If I had not visited them and challenged their sums my son would have had his car re possessed. They also tried to charge £100 for 2 unpaid Direct Debits, when we visited the bank to investigate this Welcome had never set up the DD in the first place.0 -
Hi, After my complaint to the co-op bank re mis-sold PPI was declined i went down the FOS route and it took approx 6 weeks for the FOS to decide the co-op were at fault, not only do they have to repay my existing loan but also my previous loans plus interest, which i had not even complained about! They have to set up a new loan minus PPI and deduct all previous PPI payments from the previous loans and existing loans, This was 3 weeks ago and still waiting for the bank to get in touch, they only have 4 weeks from FOS final letter so we will wait and see what happens, but i seem to be very lucky with having to only wait 6 weeks for FOS decision. But for everyone out there wondering if it is worth it trust me it is, will let you all know my final figure when the bank eventually get in touch!0

Well done i've had my complaint with the FOS since January and it still hasn't been passed on to an adjudacator.

Ive got 3 loans with Welcome that im trying to get PPI but reckoned I couldnt get anything from them on my own.With Dawson Hart and hopefully should here back from them in the next couple of months .0 -
Help, got this letter from G E Money today
I appreciate that due to recent press coverage regarding insurance regulations and GE Money being fined by the FSA you feel you may have been mis-sold the credit protection insurance on your agreement. The fsa fine, and the associated media coverage, however relates to policies purchased after 14th Jan 2005 when fsa's insurance conduct of business rules regulations came into force.
I can confirm that your policy was set up on 9th june 04. As this was prior to Jan 2005 the fssa's decision is not relevant but all complaints alleging that insurance may have been mis-sold are taken very seriously and I have therefor fully investigated all aspects of your complaint.
Credit protection insurance was placed onto your account as this option was signed on the finance agreement in the dealership. I can also confirm that the dealership is independently authorised by the fsa to provide and sell insurance products directly. As the sale of the insurance was made with the dealership we would not be liable for this action and any issue surrounding the sale of the product should be raised with the dealership.
Should you wish to cancel your credit protection insurance that remains on your agreement, please place this request in writing to our customer service team.
Whilst i appreciate that this may not be the outcome you were expecting, i trust that i have addressed all the concerns that you raised. If you do remain dissatisfied with our response, you may refer the complaint to the financial ombudsman service.....
1. No opt out for ppi on orig paperwork
2. car salesman advised he had no experience with ppi but i should take as would help get the loan
3. in default of the loan and no ppi should be currently being paid/added to the loan - already informed them.
What now....do I really have to pursue the dealership? Says they are regulated by FSA now but how do i find out if they were at the time of the loan....sure they werent.DFW 228 LONG H 68
