    Fairly new at all this, but I'm hoping to claim from Welcome Car Finance for a mis-sold insurance policy with a car from them. I was told that "it would help my application if I took out the extra insurance cover with them",

    My questions are :

    1. Was that mis-selling, I didn't want it, but because of the extra pressure I felt under, I felt it was the best thing to do.

    2. I have now settled the whole amount, can I still claim?

    3. I missed a few payments, but never claimed. ( Total settled now anyway ), can I still claim?

    4. Do I just fill out the questionaire? or do I just write a letter to them first?

    Who was the provider: RBS
    How much did you get back: Around £ 900
    Did you get it back after a letter or did you go to the Financial Ombudsman: 1 letter

    Hi Ady and welcome. (no pun intended lol):D

    Right all YES.;)

    You send the questionnaire to whom set this up for you from the start and they have 8 weeks to respond in full.
    More here with the stage one questionnaire issued by the FOS, keep copies as well.

    You can write a cover letter if you want to, but it seems these questionnaires covers all, but of course you do what you feel best.;)

    Hi

    I have received a reply from halifax today declining my complaint, i went down the lines of application would not be accepted if i never had cover, i was not told this was optional and i was not asked about any existing employee benfits

    They state in there letter I applied online ( which doesnt go in my favour as in my complaint i was sure this was open over the phone), and was sent an application form which i signed and returnedand at this point i signed the requisite box to confirm i wished to request the PPI to protect my repayments

    I have had a letter enclosing a copy of the credit agreement where it says you have requested repayment cover.. but no where does it show i ticked a box to have this cover i just signed the credit agreement and i cant see this says i selected the repayment cover.

    They have stated to call if i wish to discuss and state they have enclosed the right to refer to the FOS booklet, but no booklet was enclosed. this also doesnt state this is there final decision.

    Would anyone be able to confirm if this is normal for halifax ( iknow i havnt helped myself with getting my application process correct, but what they have sent also doesnt prove i asked for it, or asked what cover i may have had.

    any help would be most appreicated

    Hi Warren

    I believe your in your rights to write back to them and tell them you want this reconsidered, as you don't believe your complaint have been investigated properly.

    To me this is a standard fob off response.

    What you need to work on now is their reasons/findings for knocking you back.
    Write further information that relates to their findings.

    So despite being sent an agreement - you need to explain to them as you have done above - by stating there is nothing on the copy of the agreement they sent about the PPI.

    Tell them your not satisfied with their decision and its been totally overlooked, and if this PPI was added then it was not by yourself but by their member of staff (certainly not for your interest but for their own).

    Keep at them, and tell them you stand your ground, and if they do not uphold in your favour, you will take your complaint to the FOS with evidence to support your case, which will occur in further charges to them. Give them 7 days to get back to you.

    You could also tell them that the FSA are clamping down on rejected complaints.
    Make this letter stronger than the last one, good luck.;)

    Is this common for Halifax, I wasnt sure if i had a case with me thinking this was applied for over the phone as it was some time ago, but what they sent doesnt seem to prove i agreed to what they say was clearly optional.

    ill try and see where i get, worse case i can refer to FOS, and it cost me a stamp
