    I am beginning to think now that maybe we did take our loans out with Firstplus all along and that the loan have been sold or something dodgy is happening as we are all thinking the same things. I have rang Freedom Finance twice now and all that they say is "you took it out from an advert off teletext." I really do not remember doing this. I have now sent off a SAR to freedom finance because today i have received my sar from FP and there is no evidence of anything being sold by Freedom. I have looked at the actual application and does not state anyone as the seller. Just that they have ticked the ppi box and written our mortgage details on themselves (all out ticks are completely different). It has no heading and the other documents printed off all do say Freedom Finance plc or Freedom Finance ltd but this looks like they have put this into the computer prior to printing the telephone convo's etc. Also there is a tape and on the tape all the phone conversations that relate to me arguing the rule of 78 and the ppi are missing. They have however sent details of the conversations on these print outs and lots of times i am querying not being sent out any documents about the ppi and rule of 78. It says quite a few times that "mrs moaned about rule of 78 and did not believe had literature from freedom to say settlement would be much higher due to rule of 78. I am at my wits end and beginning to wonder whether this is worth it. I have today contacted the Information Commissioner’s Office and they have told me to write again and request the calls and that the logging on paper is written in plain understandable English. If they don't comply they will request them for me.

    I think i am just very tired now. Perhaps i will think different again tomorrow.

    I wrote a letter to HSBC RECORDED DELIVERY to the correct dept. saying that when I took out the loan it was assumptively sold, where you should be given a break down of the cost. I had a reply back saying they were looking into it and would reply back wthin 4 weeks. After 4 weeks they sent anothe letter saying they were extending it to 8 weeks, I was doubtful at this point.

    Anyway got back from work tday wth a reply saying they were upholding my claim and refunding me £2747.15 inc 8% interest.

    RESULT, I really didn't think it would be this easy as it was quite difficult with my bank charges. You don't get without asking.

    Good luck to everyone thats trying with this at the moment.

    I wrote to HSBC on the 6th February 2008 complaining that my graduate loan was mis-sold to me on the basis I was pressurised. HSBC were good at updating me with the progress of my clomplaint, but got the standard 'no' letter saying signed forms etc. I wrote again threatening court action and again got no letter, advising me to go to the Ombudsman. At this point, I nearly gave up but decided to lodge complaint with ombudsman as nothing to lose. Got letter from FO saying that they are very busy but will write to me when complaint passed to an adjudicator, so thought I would be in for a long wait-however less than a week later, I got a telephone call from HSBC asking me to go into branch and reschedule loan-I asked why and they said that they are now upholding complaint! Yipee-got 2K off total loan, £970 redress and paying £60 less a month on loan! - Have not heard from FO about this though!:T

    This is my second succes-have successfully claimed monument credit card charges of £700

    I too have written to HSBC to claim that my PPI was mis-sold and have have the letter back after 4 weeks saying need more time etc. I have been told that I will have my final response by 2nd May. Now, I did it all in branch, definately had the PPi pushed on me, and the sales person was on her last day of work for the bank so I think it's a my word against hers scenario. Fingers crossed for a result like yours rebekah.

    Can I ask rebekah, how was the money refunded ? to your loan account, current account, or a cheque ? Are you able to choose ?

  • I followed Martin's simple process and after 3 letters was successfully awarded over £1000 in PPI returns.

    Hi took out a personal loan in 2001 for £8000 with the halifax, this ran along side my mortgage and would be paid off in 2015.
    Having success with the Final payment exit fee for mortgages i recently came across the ppi mis selling article on this website.
    Using the template letter editted for my circumstances i duly sent it off to my local branch. This in turn was forwarded to the Customer Relations department of the Halifax. After eight weeks and numerous update letters saying we will contact you soon etc i received a final response basically saying that the policy would have been dicussed in full to determine my needs etc and because there was no evidence of me informing them at the time of sale that i had a pre existing illness that the policy was fair and just and hadnt been mis sold. and anyway i would have received a policy booklet at the time of sale explaining the exclusions/terms and conditions along with a 30 day cancellation period if i decided i didnt need it.
    Obviously this really miffed me big time. So i wrote back with a few items highlighted in the letter.
    An internal invesigation by its own customer relations depart found in favour of its own staff. That i had infact never received the policy booklet and would they kindly send me one now. That i had been suffering from Crohns since 1988 so this is a pre existing illness. Regarding the discusion to see if the policy meets my needs went basically like this ' you want your payments covered if your off work wont you ' and that was it-big disccusion.
    Wednesday this week i received and very badly photocopy of the policy booklet along with a letter saying again despite further information about my illness the policy was fair and just and not mis sold.
    Now having looked at the policy booklet section 2 quite clearly says ' on the start day you must not be aware of: any sickness, disease, conditions or injury in the 12 months before the start that may cause you to claim disability benefits. So i guess 12 years is over 12 months. doh!
    I guess they dont read there own policy!!!!!!!!!!!
    This has now been forwarded to the FSO to look at but may take awhile due to them being extremely busy.
    Oh forgot to say-paid the loan of early along with mortage in 2005 due to some inheirtance.

    the people who have won their PPI money back at what stage did you get it, did you have fill in court cliams forms. I have just sent first letters to loans.co.uk and london scottish brokers. wondered how long this usually takes.

    I have 2 PPI claims all being dealt with by FOS could do with a win. I also have 1 PPI claim with FSCS because company gone bankrupt.
    I have claim for bank charges on-hold for 3year

    Started claiming PPI on Barclayloan last September got usual expected response from them e.g. you were made aware of t and c and you signed etc etc. Sent to the Financial Ombudsman in December after getting their Final response. Heard back this week from FOS that they have upheld my complaint and three front loaded PPI's plus interest etc are now coming my way. Will let you know amounts and when I actually receive money.

    Did not go to court FOS have been very supportive.

  • Got an reply from A&L regarding the 1st loan I took out with them before I refinanced with them on the 2nd loan. 2nd loan I have already claimed back £1850 from them.

    Anyway got a letter from they today offering me back £510.33

    Worked out by:

    Insurance Principal £895.24

    Interest on Insurance £137.72

    Total Payable £1032.96

    Minus rebate on Insurance Principal £452.95

    Minus rebate on insurance principal £69.68

    Balance £510.33

    I assume this is what I got paid back when I refianced to loan 2 is what they are saying here is this correct?

    My OH has just been notified that his claim for a mis-sold PPI has been accepted and has been rewarded refunding all costs and interest. The loan was nearly finished so it has paid this off and left him with a credit of about £1150.
    He used Martin's template here on the MSE site and although it took several months to get this reply, he didn't need to write another.

    Barclays refunded sameday into his account and confirmed in a letter ...
