hey u how r u?just 2 let u know that stil no news in the post 2day,but no news is gud news rite, lol,i was going 2 ask u if i get a response regarding my ppi saying they wont pay me my refund where do i go from there, the FOS? and how long does it take 4 the fos 2 sort and get back 2 me?anyway i hope ur dad is ok and ur doing ok,keep ur chin up hun.;)XXX

Hi hun, not bad now thanks and you?;)

If they have had their 8 full weeks and not responded you can move on to the FOS, and again if they do not uphold your complaint in your favour, and they have given you the final response in the letter where the details of the FOS should be included as well.

Once you have sent your complaint to the FOS, within approx a fortnight, you should receive the letter from them to let you know your complaint have been received, and they will put you in the queue for the adjudicator, however, this may take some time, but once with the adjudicator, the norm is that of 6 weeks.

When the adjudicator has hold of your complaint, they will also request information from the other party and investigate both sides, hopefully then it will go in your favour, where the other party/business will agree as well, if not then normally it's a case of having your complaint moved on to the ombudsman himself.

They will vary, some can take a few weeks, and if complexed and due to the high amount of these complaints they have to deal with, it can even take about 14 months, but if your in financial hardship, on your complaint form, do let them know the details and request for fast tracking, they will consider this for you.
Again though there is waiting time for this as well, as many are in these financial difficulties at this time, but it may still help.

    Good luck.;)

No, there wouldn't be any loan left (still some outstanding) if HSBC gave that money to MCS.

They don't know how much to pay me because they haven't got bank statements going back that far. I have, and I have the loan agreement signed in 2000.
send copies in of what you have with your letter and when you get the next reply post it on here, hsbc should reduce your loan if you win mis sell i wouldnt have thought that they could not give it to mcs to come off the loan, then you need to tackle mcs about the extra charge they have put on, what a rip off!! you have already been ripped off with ppi now they are doing it agains!!

OK, you think it would be better if actual amounts were left out of the letter? A bit more like this?

    **************************************************************

Although you have offered me the sum of 6 months of premiums to cover the mis-selling of my policy, I do not think this amount is enough to cover a refund of the premiums, subsequent interest that I have paid on these premiums and the 8% statutory interest that a court would award.

Also, the rest of the loan including the PPI payments was taken into collections by MCS and I am seeking the further 54 payments to be deleted from the loan with the same 8% statutory interest.

If you were therefore to increase your offer I would accept and consider the matter closed. If I have not heard from you etc etc

    Thanks, all.

My PPI re-claim against Lloyds which has been in the hands of FOS for ten weeks now, seems to have gone a bit dead in the water.
Bloody Lloyds are still taking it off me each month(the ppi).
Can I cancel the PPI without without recourse,ie still pursue my money back via FOS whilst paying off the loan.
I know Lloyds will treat it as a cancellation but if I make it clear in my letter that I'm not going to make the PPI payments any longer will this !!!! things up with FOS when they eventually look in to my case as as this ppi is crippling me.
    Thanx

    Hi Lusty.

Please be careful. If you do not pay your PPI on your Loan it will be seen as an overdue payment and will affect your credit score. You would have to re finance the Loan. Talk to the FOS about it.

Hi All following sound advice from Di3004 I sent off my complaint for ppi to LTSB. After I few inefficiencies and incorrect information in the last 3 weeks: stating that they had received information, and following an inefficient call today, the senior advisor said that she is going to look at my complaint today with someone else. Fingers crossed for a positive resolution!!
