    Hi hun
I take it you have no paperwork in relation to the loan then?

I would maybe request a SAR (Subject Access Request) they have 40 days to comply and send everything as possible as requested on the SAR, and you need to enclose a payment of £10 cheque or postal order for this request.
    Post by recorded delivery.;)
Hope this helps and here is the link to the SAR template here:

    Good luck.;)

    Hello again!

My 2nd letter to HSBC looks like this. Do you think it is OK?

I am writing in response to your letter dated **th August 2009, with regards to the insurance sold with my loan. Your reference is ****************************.

Although you have offered me the sum of 6 months of premiums (£257.28) to cover the mis-selling of my policy, I do not think this amount is enough to cover a refund of the premiums, subsequent interest that I have paid on these premiums and the 8% statutory interest that a court would award. With 8% interest from May 2001, the total is £428.24.

Also, the rest of the loan including the PPI payments was taken into collections by MCS and I am seeking the further 54 payments to be deleted from the loan with the same 8% statutory interest. This amounts to £2315.52 plus 8% interest of £1538.69 - a total of £3854.20.

If you were therefore to increase your offer to £4282.44 I would accept and consider the matter closed. If I have not heard from you within 14 days to say if you can offer this amount, I shall be taking my complaint to the Financial Ombudsman.

    Yours faithfully,

hi acey, if your loan went over to collections and you were making minimum payments then i would just say that you are not accepting the offer and would like them to remove the ppi off your loan and repay to you the premiums you have made to date plus the statutory 8% and you would like the loan to be put back in the position you would have been without the ppi. if they refuse that then go to fos, they will work out what you are owed i wouldnt tell them , they should tell you and it should be a better offer than 6 months they have offered you to date, as the loan is in arrears they may reduce your payout by the arrears amount and if there is any left you will get this amount back. i still dont understand why if they have agreed to pay you for mis sell they will only give you 6 months premiums back, i would ask them for a breakdown of how they arrived at the six months refund as well

No, there wouldn't be any loan left (still some outstanding) if HSBC gave that money to MCS.

They don't know how much to pay me because they haven't got bank statements going back that far. I have, and I have the loan agreement signed in 2000.
