Thanks to this forum I have reclaimed £685 fro EGG and they settled in a month. However, I am having more trouble with GE Money (Now Santander) in claiming on a Dorothy Perkins and a Wallis card. They deny misselling the PPI even though they admit in their letters that most of the data cant be retrieved prior to 2005 (DP card opened 1987 and Wallis 1996). Also several key facts re the accounts they have wrong. But they are also saying that since Creation Finance managed the cards before 2004 - I should be applying to them. Creation are insisting assets and liabilities were transferred to GE money and then onto Santander. Does anyone have any experience of reclaiming from GE money?0

If you have a credit card and did not know until recently that you were also paying out for the PPI, it seems then you have a case that they possibly added the PPI without your knowledge, I used to think it was all part of the credit card myself.
I would write to the complaints office if you have one or the head office of the bank.;)

If you have requested paperwork from GE Money they should hold your details as from 2003 to now, it's that of 6 years they hold if you live in England or Wales and 5 years if you live in Scotland.
However, when I requested a SAR from one of my loan providers last year I was lucky to have received documentation as from late 1990's.
I would contact the Information Commissioners Office (ICO) if your having trouble in this way, they should help and/or guide you in the right direction with this here:

Have you actually tried requesting a SAR (Subject access Request) with a payment of £10 postal order or cheque payment?
They have 40 days to comply, and post by recorded delivery, they should send you everything they still hold on you going back from the years as stated above.

Yes I did ask for statements and they did send them but many were missing. the covering letter stated quite clearly that they were unable to retrieve large chunks of data on the account.
They are blaming Creation but I have asked a solicitor neighbour and he is quite clear that when you take over a company you take over liabilities as well as assets.
They claim I agreed to the insurance on the Dorothy Perkins account in 1987 but cant provide me with a copy of the agrrement! I wasnt working in 1987 as my children were tiny so why would I need insurance? Also I was told it was compulsory.
In 1996 I opened a Wallis account and was also told it was compulsory. At the time I was on a fixed term contract of employment and clearly remember asking the sales assistant if I could claim if/when it came to an end. She said no but the insurance was compulsory.
In the letter of rejection they state that they sent me a policy update in 2004 when GE money took over from Creation Finance. They did , and I wrote to them asking the same question about Fixed Term employment. A person from GE Money rang me to say that as I had a balance on the account I had to keep the insurance and no I could not claim (I have never claimed by the way). They are now saying they have no record of the letter or the call but in the next paragraph they admit tat they have no data on my account except for my payments prior to 2005.
I have now written them another letter asking them to re-consider but I am not hopeful. Any ideas gratefully recieved.0 -

Well you have done the right thing in writing back to them so good one.;)
They seem to have contradicted themselves as well don't they.
Just a thought but if the FOS cannot deal with them, if you decide to take this further if they do not resolve for you, maybe the FLA (Financial leasing association) "may" be able to help, although I know this is not always the case but worth contacting them just in case perhaps.

First time on this thread and ive read most of the articles on here regarding ppi reclaiming although i havent read this massive thread yet but i will do,
The thing is im looking to find out if my brother can claim but i cant find it anywhere as i dont really want it to get far if he hasnt got a chance.
My brother got a loan 5 years ago from Yorkshire bank and has just finished paying it off but my dad was his guarantor (sp) so the actual loan was in dads name but my brother paid for it out of his account, he was too young with no credit score so this is the only way they'd give him a loan
When my mum checked he'd paid well over a thousand pounds for his ppi but my argumant is~ he shouldnt have been paying for it as who would they pay out ppi for my brother or my dad?
So would he be able to reclaim it?

Yes its all free, apart from a few stamps.:D;)
You write to them by giving your reasons on how you believe you were mis sold the PPI, and request that they refund you all the PPI you have paid and the interest, plus 8% interest on top of what a court would award.

Keep on at them until they resolve in your favour, or until they issue you with the final response, this final response should give you details of the financial ombudsman service (FOS), you can take your complaint to them if your not happy with the outcome of your complaint, and again all free.;)
Post all letters by recorded delivery, this is your proof of posting.

So was it your dad's details on the agreement or your son's?
If your dad's and this was added without knowing it can still be reclaimed and the same goes for your brother.

Check the info and the mis selling checklist, whoever's name is on the paperwork can try to reclaim on this PPI and the interest, also the 8% interest of what a court would award.
I would also check on the checklist for other reasons as well.
Write to them to reclaim, they have 8 weeks in full to respond.
Basically keep on at them until they resolve in your dad's or brothers favour, or until they issue the final response, if your not happy with the outcome they can go to the financial ombudsman service (FOS) if eligible, the details of the FOS should be disclosed on the final response.
It is best suggested to post all letters by recorded delivery as well, as this is your proof of posting.
