    Just wanted to let you all know that you can win.

    I received a cheque for £2800 from Britannia Loan (underwritten by BOS) and £800 for Britannia Credit card PPI.

    I have written to EGG card and asked for PPI refund, but they are refusing due to application completed online.

    I am going to keep chasing this as I think they still have a duty of care to customers.

    well done, you go for the online one with egg, we are mere consumers and the fos dont look too kindly on banks who think we should know what all the small print means on a form, it is the duty of the banks to inform you better. the same rules apply online, on the phone, or in person. you go to fos with this and good luck

    Process: Sent original letter June 2008, usual tact of denial! - went to Ombudsman and after being stuck in the system for what seemed ages, as soon as my case was allocated to a case worker payment was made back to my account! Hurrah :j:j

    Have just realised I can claim CC charges so am writing back to them now.....!! Thank you everyone on the forum for info and ideas :T

    Could this be the week that dear old Picture is declared in Default?? I very much hope so, I think its about time our claims were sorted!!!!

    Letter or Ombudman: Ombusman

    After reading an article in the Sunday Times November 2007 regarding PPI mis-selling, I asked my partner if he had this type of insurance on his Barclayloan that he took out in August 2001, way before I met him. He had no idea what PPI was, or even if he had it. Being an avid money saver myself, we investigated.
    Turns out that yes, he had been paying a single premium PPI of £4246 (plus £1942 interest) on a £15000 loan and he hadn't realised. My partner works for the NHS who have a very generous sickness payment scheme and I thought if he realised what PPI was at the time, he would not have wanted or needed it. We read Martin's advice regarding potential PPI misselling on this website and downloaded the template letters to send of to Barclays.

    23 Nov 2007; Letter to Barclays claiming misselling and requesting refund.
    3 Dec 2007; Reply saying they will look into our concerns.
    21 Dec 2007; Another reply, still looking.
    15 Jan 2008; Fob off letter, "postponing complaint..outside 6 years...sorry you feel that way...get more info from FOS..blah blah"
    Jan 2008; Sent template letter to Ombudman.

    We had regular (monthly to begin with, then 6 monthly) update letters from FSO who were very busy and it wasn't until 22 April 2009 that the case was finally given to an adjucator.
    In May 2009, the adjudicator wrote saying he found in our favour, and that Barclays had missold the policy, as they should have pointed out it's limitations for an NHS employee. He stated that Barclays would be informed of his conclusions.
    Barclays did not agree with him, so the case went across to the Ombudman himself.
    One month later, 22 May 2009 (last Friday), the Ombudman made his final decision. He also found in our favour, wrote Barclays a stinging letter regarding their temerity in disagreeing with his adjudicator, and "requires Barclays" to pay up, with 8% interest and £200 distress money.

    HOW GOOD IS THAT!!:j

    It has taken 19 months from 1st writing to Barclays to get the Ombudsman's decision.

    Many thanks to Martin and everyone else here for their advice. To everyone else waiting for a decision on their claims, just hang in there and good luck.

    after 13 weeks i had a letter offering me £1714 in settlement, plus two lots of interest, the 8% and the interest i would have paid on the PPI.

    So this brings my loan PPI to a close (once i know the full final figure) only the CC to go now.

    I look forward to the cheque arriving now.
