I have a strong case which is now with the FOS against loans.co.uk who have been fined, sold me a single premium policy added to the loan and interest and who have given me their final decision not to refund based on the statement that I had 30 days to consider and cancel the PPI. I filed my case with FOS in February 2009 and have had a standard email from them to say;
"I can assure you that your complaint is progressing here at the Financial Ombudsman Service and we have obtained the file of papers from loans UK in order to complete your case file.
I apologise for the delay in assessing your complaint; however, we will keep you informed of progress. Once your complaint is passed to an adjudicator, they will contact you directly."
Did you get contacted directly and how long from when you filed with FOS did it take to get a decision?:T
Hi Sugarhouse,
My case against Loans.co.uk has been with the FOS since January 2008. It was passed to an adjudicator who upheld my complaint and recommended that Loans.co.uk:
'(a) calculate the amount the consumer paid in total in respect of their overall loan, including fees, penalties, as well as interest and repayments and reflecting any premium refund allowed on cancellation of the PPI policy;
(b) calculate the amount the consumer would have paid in total had the original loan been taken without the additional borrowing to fund the PPI, but assuming it was settled on the same date (including fees, penalties, as well as interest and repayments);
(c) pay the consumer the difference between (a) and (b) plus interest at 8% per annum simple from the date their loan was redeemed to the date you pay this compensation'.
However, Loans.co.uk obviously rejected the adjudicators assessment so it was passed for a Final Decision by the Ombudsman in June/July last year. Round about Christmas time I emailed the adjudicator to find out how my claim was progressing and advised him that I was experiencing financial hardship. He asked me to give details of my situation, which I did, and up to the present time I am STILL awaiting a final decision!!! I've sent numerous emails, made phone calls and left messages on answer phones which have only been returned on 2 occasions, and as a last resort wrote to the FOS. Their response was 11 words confirming receipt of my letter! Nothing else!! The last time I managed to speak to the adjudicator a couple of weeks ago he told me my complaint was 'near the top of the pile' so I should hear in a couple of weeks. I'm losing the will to live with the whole blooming thing at the moment.
So, Sugarhouse, don't hold your breath! I just keep thinking I've been waiting so long it can't possibly be much longer. Can it?????
Incidentally, I paid off my loan in just over a year when I sold my house.
Congratulations to everyone whose won their cases though! It gives me hope - and boy do I need hope!!!!!!!! :beer:

Having had the e-mails from Martin for a long time and watched and listened to his broadcasts, I decided to reclaim PPI on an Alliance and Leicester loan which finished in Feb 2008.
Using the templates, my first letter was dispatched on 3rd Feb 2009 giving them 8 weeks to refund the premiums plus the statutory interest and I received a prompt acknowledgement. Received further letters saying it was still being looked into but nothing positive. After 8 weeks gave them a further 2 weeks. After that, sent the final letter that I was going to the ombudsman and filled in the form and sent it off. Three day later offered full refund of premiums (£499.68 plus 8%interest payable to 30th April 2009 totalling £108.26) - grand total of £607.94. RESULT - Thank you Martin and perseverance pays off.

Hi Di,
Yes, still waiting! Going into month 16 with the FOS now!!! Also still waiting for the smaller PPI amount (274.56) to be paid back into my NatWest account, the bigger amount went in a few weeks back. Apart from that I'm okay. Overworked and underpaid, the usual story! My family are all well, had a nice weekend with my 2 little grandsons (no arguments or fights for a change!!) and the baby is gorgeous! She's just over 6 lbs now and 3 months old and thankfully doing really well! She's got everyone wrapped round her little finger though!
Hope you and your family are all well. Its good to hear from you!
Take care. X0 -

It is disappointing to read of the pain caused by the delays at FOS who are inundated with PPI complaints. FOS had asked FSA to force the companies to review their past PPI sales, but this was declined and you can read the FSA's letter on the FOS PPI website. This has denied everyone the opportunity of compensation without the need to complain to FOS. If you think there should be a review, as there was for endowments, write to the FSA and complain.0
