Failure (marks and Spencer's) credit card that I took out in 1990. Still deciding whether to take it to the next step (ombudsman).
Do check your rejection letter from Marks & Spencer. Does it include instructions on how you can refer your complaint to the Ombudsman? This is unlikely, given that the sale of your PPI took place 15 years before the regulation of insurance products began.

However, you may be able to complain to the underwriter of the insurance and FOS will help you with this if possible.

Pre-2005 sales it depends if M&S or the person that sold it came under the regulation

A relationship has already been established - Allianz take on these cases and the Ombudsman will look into them.

However, the uphold rate is incredibly low.

There has to be a very specific set of circumstances and the actual complaint needs to be very compelling.

I took out a mortgage in the 1990's and was made to take Mortgage Payment Protection by my then lender. I was told this was compulsory, is this the type of PPI miss-selling that MSE is suggesting that we look in to reclaiming?? Can anyone advise please? tia

Can you prove it was not compulsory to take it out? If it was the bank policy at the time it was not a miss-sale

Sam Vimes' Boots Theory of Socioeconomic Unfairness:

People are rich because they spend less money. A poor man buys $10 boots that last a season or two before he's walking in wet shoes and has to buy another pair. A rich man buys $50 boots that are made better and give him 10 years of dry feet. The poor man has spent $100 over those 10 years and still has wet feet.

Since in the 1990's it very often WAS a condition (usually in exchange for "free" mortgage advice) it would be wise to investigate whether you were actually told the truth here.

It's only mis-selling if you were told it was compulsory when in fact it was not.
  • I'm writing this from Lima, Peru.

I'm at the end of a 14 month trip where we've visited everywhere from Machu Picchu to Antarctica after getting a surprise PPI settlement from a very old Lloyds loan and funding a sabbatical. We've learned Spanish, scuba diving, sailed the Amazon and experienced much more.

Home to the UK in 3 weeks but unforgettable trip thanks to your tips!

    Thank you
  • I have contacted Littlewoods about miss selling Ppi and they have been awkward towards me please any help on how I can be successful Thanks
  • I was told by capital one that i requested Ppi but as it wouldn't be any use to me as I was ill can I claim a refund on miss selling as I wouldn't have been able to use it.:mad::mad:

You can be successful by presenting a valid and compelling complaint. Otherwise it is likely to be "awkward". :)

Seriously, you need to detail the circumstances of your complaint and why Littlewoods have not been co-operative. Could it be that you have no documentation and Littlewoods have no records? Or is it simply that you are complaining about a time prior to regulation (2005)?
