They cant. Which is why most complaints on that particular point do not succeed. However, a complaint is required to be looked at not only looking at that reason but the overall sale and many will go on to be successful for a different reason. Often one not raised by the individual.

Thank you everyone for your help. After initial rejection and 2 years with FOS have today received uphold letter for 4 loans with Halifax. Best Christmas present ever :beer:0

I had a loan with The Loan Company in 2001. I found out it included, without my knowledge, PPI. I put it in the hands of Money Boomerang but, after eighteen months of very little contact and no success, they returned all documents to me. I then put it in the hands of the Financial Ombudsman who, within six months, generated over £3500. The message? Follow MSE's advice and DIY.0

Just been offered over £600 for PPI re a small personal loan I took out with TSB in 1988

I always felt it had been charged unfairly and unjustly so had hung on to the paperwork, (and nursed the grudge too!) but never had the nerve to chase it up and challenge. Thanks to your site, though, I finally put my case after months of dithering, and now success within weeks of using your template forms. Without any appeals, etc. either.
Only wish I had done it sooner, never expected it to be so straightforward, all thanks to your site that I went ahead,
Hope this encourages other nervous but justified victims, and a big Thank you for your solid advice!

I decided to investigate if we had been charged PPI for small loans & credit cards over the years, 90% certain that we hadn't.
We'd heard a lot in the press about mis selling & banks being fined.
The first call was to Lloyds. Shock horror - PPI was on a credit card but stopped 2 years ago. Completed the claim form to the best we could remember (lots of blanks as it was a long time ago we received the card).A couple of phone calls from the bank & we received a cheque.
Black Horse - Shock horror FOUR loans had PPI. A few more forms completed. 2 claims paid but 2 had a more aggressive interrogation style of phone call. The PPI was life insurance, the bank didn't ask/ check if we had or needed life insurance when we took out the loans, if they had we could of provided proof we didn't need anymore.
They settled the claims over Christmas.
So from being 90% sure we didn't buy PPI we have banked around £4500 which is fantastic news. Unfortunately this has left a Very sour taste. Theses institutions were looking after their interests only. Gone are the days of trust & integrity it's now greed - every man for himself. We've now become claim junkies. Are we just as bad as the banks? Why wasn't this behaviour stopped a lot sooner? We've been left feeling very foolish & Nieve.0 -

It should be noted that every month you had that credit card where you didnt pay the balance in full, the PPI payment appeared on that statement. This just highlights why you should check your statement transactions. What else have you missed in that period? retailers using incorrect amounts? duplicated transactions? fraudulent transactions?
If you are putting in valid complaints then that is not a problem. If you your complaining to firms for no reason other than to try and blackmail them into paying out then that is not good.
As for why it wasnt stopped earlier, that is a good question. The regulator knew it was retailed this way for decades. There was never an indication that the regulator had any issues then virtually overnight, the regulator changed its viewssI am an Independent Financial Adviser (IFA). We tried to claim for mis sold PPI in 2011 and they rejected the claim, I did an online FOS claim but had nothing back, I know at the time it was taking the FOS a very long time to deal with all the claims, anyway forgot all about it till a few weeks ago, called FOS and they have no record of it. So after looking at Martins site I noticed there was a comment about been rejected before and that if you felt the company had not treated your claim fairly you could write to them to look at it again, which we did. Now had a response:
'We confirm we sent our final response to this complaint July 2011.'
'As we have already issued you with our final response please note that we will acknowledge further letters from you but we will not change our decision. In addition we feel that the FOS is unable to arbitrate on this case as we believe this complaint to be time barred.'
'The reason why we feel this is due to DISP rule 2.8.2
1. more than six months after the date on which the respondent sent the complainant its final response or
2. More than:
a. six years after the event complained of
b. three years from the date on the complainant became aware that he had cause for complaint.
Is it worth trying to put this to the FOS now?0 -

How did that work ? You would have had to go to the seller first, The Loan Company, they would have rejected your claim as it was pre regulation and they did not subscribe to the Mortgage Code at the time so FOS would have no remit to adjudicate ?I had a loan with The Loan Company in 2001. This process could not be more simple; I had a credit card with Capital One from 2004 - 2010, the monthly balance was paid in full every month. I thought it's worth trying the PPI claim regardless. Last Wednesday I downloaded and completed their online questionnaire, filled it out and returned it. 9 days later, I've had a letter stating that a cheque for £644 is in the post. I thought I would not be eligible as their website states they only charged PPI on outstanding balances. To anyone thinking that it's not worth trying if they paid their balance in full each month, go for it! I've had no wrangling, no lengthy calls to premium rate numbers - just the cost of a 1st class stamp. Although they were in the wrong for their slippery means by which they charged for PPI, their response to this complaint could not have been better. Go for it!0
