PPI Reclaiming successes and failures

So far so good - finally got spurred into action by MSE!
I have lodged several complaints for PPI and have started scoring some successes...
1. Barclays, loan, upheld, cheque/offset totaling just over £7,750 received four weeks after submitting complaint!
I have also been told that two other complaints (for a loan chain and for OD protection) have also been upheld and are in calculation stage
2. MBNA/Virgin cc, upheld, letter received today saying a cheque will be on its way for c.£750
Still waiting to hear on three others, plus waiting patiently for a Halifax SAR to come back as I know there was PPI but don't have all the details.
I spent a lot of time researching through the MSE forums (thanks all - there's some people here who have really gone out of their way to help over the years, and I can't express my gratitude enough! Amersall, MoneyIneptitude, Nasqueron, di, magpiecottage, and others, too many to mention - you are stars!) and I also spent a fair bit of time putting together my arguments to back up the complaints.
Aside from some thinking time and the price of a stamp, it really is an easy process to do. If you're reading this and still thinking of using a parasite claims company in spite of the warnings - DON'T!!! It ain't rocket science. You won't save any time or hassle getting a company to do it for you, but you will lose a massive chunk of any successful complaint to a CMC who will do absolutely nothing, squat, zip apart from put a stamp on the envelope for you.
Even if none of my other complaints are upheld, I'm still £8,500 better off than I was six weeks ago (and counting) - and suddenly feeling very Christmassy! Thanks again MSE

You do not "reclaim" PPI, you make a complaint about miss-selling (this, while it sounds pedantic, is key because you are making an allegation of wrongdoing against the person who sold it to you - there is no free pot of money for people to reclaim from).
As such with your mortgage you need to consider the following:
1) How was it sold to you - a broker / in a bank?
2) When was it sold (if an independent broker and 10 years ago it would be before the 2005 regulation started so they can dismiss it)?
3) What are your complaint reasons and can you prove them?
A mortgage is a life changing debt and should you fail to pay it, you can lose your home, thus you would need a very good reason why you think the PPI was not suitable for you (such as multiple pre-existing medical conditions that would prevent it ever paying out). MPPI can be a vital safety net should you lose your job and can help you keep your home, therefore if you feel it was not suitable then you need to consider both why, and whether you can prove your assertions.Sam Vimes' Boots Theory of Socioeconomic Unfairness:
People are rich because they spend less money. A poor man buys $10 boots that last a season or two before he's walking in wet shoes and has to buy another pair. A rich man buys $50 boots that are made better and give him 10 years of dry feet. The poor man has spent $100 over those 10 years and still has wet feet.

Double success for me, one totally unexpected!
I had claimed mis sold PPI on a credit card with Lloyds TSB recently, I wrote them a letter and filled in a form, someone called me a couple of weeks ago to get some further information, then I had a letter last week stating that they had upheld my complaint, and that I was due £2889, the cheque arrived today!
Just in time for Christmas, I intend to use the money to pay off a credit card, as we are in the process of drastically reducing our credit card debt, and doing well so far, this is even better!
As a bonus to this, I have done all my Christmas shopping without using credit at all, so its all old card debt that I will be paying off.
Also, a couple of years ago, I successfully claimed PPI mis-selling on a couple of loans that had about 10 years ago, again with the then Lloyds TSB, long since paid off, and had already been refunded about £3600, I had another letter from them a couple of weeks ago saying that this had been miscalculated, and that I was due back another £1410, they would pay this into a loan account that I currently am paying, and that had almost another 2 years to run.
I also had the notification by post today that this payment had been made, not only reducing the balance, but saving me £350 in interest, and reducing the term of the loan to finish in 18 months.
Also looks good for my credit file, which helps a lot, as we are planning to remortgage in 2015 once the credit card debt is down a bit more, this has really helped a lot.
I would say to anyone that was unsure about making a claim, providing you have good grounds to claim mis-selling, do it!
It's not hard, or complicated, and I have claimed back several thousands of pounds over the last three years, and just by filling in a couple of forms and confirming information over the phone.
Really happy, and because I am also due in January to pay back some money to me that I lent to one of our companies earlier this year to replace two laptops, that will be another £2000 paid back to me, which I will also use to pay down credit card debt, making a total of almost £6300 that will be gone forever.
A great start to the festive season!Making time for me now. Out with old habits and ideas, and open to change......:j0 -
We have had over £8000 back in PPI payments.
In Sept 2007 we claimed £450 from Britannia credit card for PPI
In 2012 we received £5690 from Lloydstsb
In July 2013 from MBNA we received £111.79
Last month we received £1541 from Britannia (Halifax)
and £493.52 from Britannia (Halifax)
It is shocking that during the time that we were getting financial assistance from Payplan and CBA and handouts from my old teaching union Halifax had all this money owed to us. It took six letters from me just to receive the paperwork relating to the money we had paid out in PPI. I eventually sent a signed for letter and then received a reply. In all of this Lloydstsb were the easiest to deal with.
Total PPI is £8285
Next to come is £1527 from C0-op for a charged bank account. We are hoping this will arrive in time for Christmas.business mortgage £0))''(+ Barclay's business kitchen loan £0=Total paid off was £96105 PPI claimed and received £13527

Can I still claim back the PPI on this loan?
Try it. Fill in the Financial Obudsman Service's form.
I did that for my Egg loan (about 2000) and just put 'don't know' or estimates for most of the questions, making sure that I emphasised the misselling aspect. 3 weeks later, I have a decent offer from the people now responsible.0 -

Probably an auto-payout or some other failing (Egg were known for a period to use pre-ticked boxes for example).
A claim that you HAD to have PPI or no loan is either the truth (in which case, not miss-sold) or an unprovable allegation.
However, for a small amount under the bank's auto-payout limit you might get lucky so putting in a complaint may workSam Vimes' Boots Theory of Socioeconomic Unfairness:

Approximately 8 months ago I received an email from the Financial Ombudsman stating a new computer system had been installed and as a consequence ALL my files had been lost and I was required to apply again! I have since moved home and cannot find the required information to re-start these claims.
Is there anything at all I can do?
I suggest you write to Caroline Wayman, Chief Ombudsman complaining that losing your personal data is a breach of the sixth Data Protection Principle, that, having entrusted it to the care of the Financial Ombudman Service, you are no longer in a position to resupply it, and that you require them to put you back into the position that, but for their error, you would no be in.0 -
A quick, positive, entry to say that in August 2012 i challenged two lots of PPI on Halifax mortgages taken out, successively, in the early noughties. I filled the claim forms myself through Halifax's instruction. The claims were rejected in Oct 2012.
Today Ive received a letter from Halifax to say that both claims have been re-assessed and will now be upheld, with £1084.96 due back. Nice surprise just before Xmas.
Interesting to note that, on this letter, they describe their original decision not as 'reject', which it definitely was, but now as 'defend', suggesting they were in the wrong two years ago but wouldnt pay out. Berks.0 -
Hello, and Merry Xmas to all.
Brand new to all of this so apologies in advance if I've done anything wrong!
I've been having a good look through the various PPI posts and information on this site. I'm trying to help my parents investigate the possibility that they were mis-sold PPI - I managed to steer them clear of a Claims Company at the last minute (phew!) who had cold-called, asked some questions and 'implied' that they had a legitimate case. Their main 'selling' point was that they felt my parents shouldn't have been told that PPI was compulsory by the lender and that this was mis-selling. Now I thought that this would be a difficult conversation to prove, and there are a number of comments by experienced posters on this forum that indicate that this is not a viable course. Yet on the main site, Martin states that:
Examples of mis-selling include:
Being LIED to that policies were compulsory – they weren’t.
How could anyone ever prove/demonstrate this?
Interestingly enough, I was offered a very reasonable Loan myself (and only a few years ago, in fact after the PPI saga really took off). It was all going well, until I indicated that I wasn't interested in any type of PPI. The member of staff at the bank was visibly crestfallen, and said that I might not be able to get the loan, or at the same interest rate if I didn't take the PPI. I remember this well, as it was smack bang in the middle of the press really going for the banks regarding mis-selling. I'd never be able to prove it though.0
