    I will do that Amersall.. thank you..


    The same company upheld a ppi for another loan with them in 2007 and there were no changes to the application,it was in hands of ombudsman but they settle before they looked at it.

  • I contacted catalogue companies and requested refund for ppi using form down loaded from website they rejected, so off to ombudsman I went and waited for 18 months or so to be told they could help because was taken out pre 2005 any ideas from anyone what else I can do ????

    You could try the underwriters and may get lucky, may not.

    It's pre-regulation because the rules came in from 14/1/2005 then they don't apply to a sale before that date ergo the FOS can't help with this sort of catalogue complaint.

    Sam Vimes' Boots Theory of Socioeconomic Unfairness: 

    People are rich because they spend less money. A poor man buys $10 boots that last a season or two before he's walking in wet shoes and has to buy another pair. A rich man buys $50 boots that are made better and give him 10 years of dry feet. The poor man has spent $100 over those 10 years and still has wet feet.

  • I recently claimed on two policies that HSBC have upheld but on the offer letter they also mention another policy that i did not claim on and have declined this complaint. The reasoning contridicts the upheld cases so think i will take this to the FOS. However, can i do this if i accept the offer on the other two policies as techincally their offer letter only only mentions it is full and final settlement in respect of the two policies and makes no further mention that if accepted you cant take the third one further.

    Any view on this please.

    If you have not complained about this third one (though the fact the bank have rejected it suggests you maybe did ask them after you sent in the main complaint - or they just took it upon themselves to investigate everything) then you can start a new complaint - but may be best to double check with bank to see if they believe you have complained about it (regardless of what you think has happened) and if they have issued a full and final rejection - in which case you have 6 month limit to go to FOS so get on that

    If you paid the PPI in with the loan payment each month, this is Single Premium PPI and one reason you could use for mis sell, this is in effect a loan on the loan repayable to term end with interest, if you settled the loan early you would have been given a rebate of the PPI but the remaining PPI would have been repaid by you in the settlement figure, so you repay the majority of the PPI back anyway, none of this would have been explained to you I guarantee.

    Had this been known to you, it is possible you would not have taken this PPI.

    If you had life insurance that would have repaid the loan then you may not have needed the life cover the PPI offered.

    Your Husband had a good sick package that paid for 12 months? if so, it is possible the PPI only covered you for 12 months too, so you did not need that part of the PPI either, you have to show reasons why you did not need it, use all 3 above and ask for the claim to be reconsidered.
    Pre regulation sale so an advised sale did not exist so majority of that is irrelevant

    How many consumers know how Single Premium PPI actually works, advised or not?, if it was advised then I guarantee that the full cost or unfair rebate would not have been explained in full and the consumer, if non advised, would have no idea regards to what the early settlement actually entailed.

    Rip off on early settlement, another loan with interest to term end with cover that most people do not need or could even claim on.

    Not saying that, 2004 advised and non advised did not exist full stop = no claim unless subscribed to another code such as GISC etc

    Point taken and I know that but as the Ombudsman has asked for further info, as op stated, maybe this will be looked at again,who knows?.
