PPI Reclaiming successes and failures

A friend who successfully got back £13,000 from her PPI refund advised me to just ring up the bank. I spoke to a man who said he'd send out a claim form which I had to return.
The claim form arrived (all 10 or so pages of it), to which I had to photocopy it for each & every loan/credit card I'd ever had. Then came the tedious task of filling them all in, but some of the questions were ridiculous, eg. what was the name of the person who sold me the loan, etc.
Then came the phone calls! I got asked all kinds of personal questions along with questions to which they knew the answers to. They were asking all about my circumstances, my employment, even when I thought about leaving one company to join another. I asked them how the questions were relevant but got told that they had to work out my circumstances at the time.
A couple of days ago I finally got a letter back from them. According to them they don't believe they mis-sold me PPI…as I had a need for payment protection! They have since closed my file.
I'm now unsure whether I'm still entitled to that money or whether I'm just one of the unlucky ones who get nothing.
Can anyone advise?

Why is that ridiculous? You are making an allegation about an individual. Some of those individuals could be personally liable for the complaint. So, it helps to know if you can identify them. I know a complaint where the person was adamant that they were wronged by an individual and named them but it turned out that person wasnt even employed there at the time. Again, quite normal. If you are making an allegation of wrongdoing they have to ascertain whether your allegations are likely to be right or wrong.I'm now unsure whether I'm still entitled to that money or whether I'm just one of the unlucky ones who get nothing.Can anyone advise?
You have not given your complaint reasons, what evidence you have or what they have countered your reasons with. So, until you do, no-one can advise.I am an Independent Financial Adviser (IFA). Thanks for all info on this matter, had 2 out of 3 claims resolved, Tesco credit card paid out over £1800, and now HSBC paying out over £3800, only one rejected has been Capital One,they sent me a transcript of a phone call, which shows I accepted the condition/terms etc. Not sure if I have a case there.

Just wanted to say a huge thank you to the MSE Team and to everyone who contributes to helpful advice on this forum.
Over the last two years my husband and I have used the template letters from this website to successfully claim back mis-sold PPI from 3 loans through Northern Rock, First Plus and Barclays Bank. This week we received a second payment (the first payment from Barclays was only partially awarded to us until the Financial Ombudsman stepped in and agreed the refund should be fully awarded to us) from Barclays Bank for £2,250 which brings the total amount of PPI we have been refunded over the last two years to £10,047.
I'm so glad we worked through this process and followed the steps given on here. Before we started this journey it seemed such a daunting process and we really did not believe that we would be paid any money back at all but the information on this website has made the whole process straightforward and stress-free.

Just got £400 from Barclays from mis-selling PPI on a credit card they issued me with back in 1989. Absolute doddle, took just over a week to get the cash from submitting my initial claim. Only regret was I didn't do it sooner. Easy money. Thanks for all of the advice on here0

I am after some advice or to ask if anyone has experience of claiming PPI through a small claims court?
I complained to Natwest Credit Card back in 2013 about mis-sold PPI. I followed all the instructions from MSE.
First I requested my original agreement and details on PPI I had paid and enclosed a £1 cheque. They replied saying that I need to send in £1 (which I already had and they had cashed) to get the information I was requesting - clearly they did not want to give it to me. After a few letters back and forth I got a blurred copy of my agreement from 1993, but they would not give me details of how much PPI I had paid and when I took it out.
So I went for the compliant using the complaints form, which I have to say worked for 4 other creditors. After a while I got a reply back from Natwest saying that I applied for the PPI on my original application and therefore was not prepared to pay it back (in short). They then went onto say this was there final response and I had 6months to contact the FOS.
After 8months while I was clearing out I found the original copy of my application form from 1993 (I always liked to photocopy everything) and it clearly showed that I did not have PPI when the card was taken out. And anyway I was a student (stated on the application form) with no income so they should not have allowed me to have it anyway. So, I complained to the FOS after 8months (2months too late) who said it would look at the new evidence.
Today I have received a call from the FOS to say that as there was a delay (of 2 months) they can not up-hold my complaint, and that if I did not agree with this I could complain in 21 days and the case would be reviewed by an ombudsman but they would say the same. They commented that they understand that Natwest have clearly lied in their letter and not been forthcoming with information but I should have complained in the 6month window.
I am clearly not happy as I have proof that Natwest have lied all the way down the line. So, my questions are:
1.) Is it worth complaining to the FOS within the 21days?
2.) Can I get the case reopened by complaining to Natwest again and stating that they lied?
3.) How can I get Natwest to tell me exactly when PPI started to be applied (I was forced into taking it on the phone but I can not recall when) and how much I paid? The account was only closed this year so they still have records.
4.) Should I write to Natwest threatening small claim court (I estimate the amount to be claimed at £9500) and see if they panic?
5.) If I go to a small claims court am I likely to win and how much will it cost if I don't?

I think you need to stop being so aggressive about everything. Nobody has "lied" about anything. The person investigating the complaint is trying to look at a 20 year old sale for which there is likely to be scant documentation available. The form you have found could be for any card, many people have several at once.
If you don't agree with the decision reached by the FOS adjudicator, you can ask for an Ombudsman to review the matter and that includes jurisdictional issues. However, unless you have a good reason for not being able to refer it to FOS within six months you are not likely to have much joy. Regardless of what you or FOS think of your case, if you are out of time then you are out of time.
As regards when the policy started and how much you paid, you can call or write and ask this specific question. However, as it was 20 odd years ago there's no guarantee they actually have this information.
As regards threatening small claims court, they are a multi billion pound business which no doubt has a massive legal department and dozens of lawsuits going on at any one time. Do you really think somebody threatening a court action over a PPI matter is going to "panic" them? "Oh not another one" is more likely to be their reaction. Plus, your chances of winning are slim to none. You haven't said what your complaint reasons were or the reasons for rejection, but unless you have hard evidence to support your allegation of wrongdoing, it won't win in court.0 -
I would not use a claims company !!
Have you requested a SAR from Nat West it costs £10 .
Also I would keep the Fos on the case too .
I would send copies of the documentation you found to the FOS and Nat West PPI dept .
No, me neither, they can do nothing that you can't do yourself.
As regards FOS, this is a waste of time, they've already said it's outside their jurisdiction as the OP complained too late and no amount of "evidence" is going to change that.0 -

What you were sent was not a "claim form" (which is what you get if you want to use the insurance). It would have been a questionnaire asking for information regarding your complaint. Normally companies tend to use the FOS one, but this doesn't ask for the name of an individual person so it may have been their own equivalent.
You did not "have to copy the form for every loan or credit card you have ever had". You only need to complete it for products where you believe you have been missold PPI by the sales adviser and want to make a complaint . Completing it for every product you have had indicates a "chance your arm" approach and case handlers can spot it a mile off.
It is also not ridiculous to ask you the name of the person you dealt with. In a thorough investigation, they would speak to that person and get their version of events so that they can assess the reliability of both parties. They may wish to do so. This rarely tends to happen in PPI due to the size of the issue and the time passed since the events, but in an ideal world it would.Then came the phone calls! Correct. They need to assess both whether there were any demonstrable sales failings and, if there were, whether you would have taken the PPI without the failings. This includes reasonably foreseeable changes to your circumstances.A couple of days ago I finally got a letter back from them. You were never "entitled" to it to start with. That isn't how it works. It's not some pot of free money that you claim your share off. You are basically accusing someone of misconduct and claiming that they conned you into buying a product you wouldn't have done otherwise. They have probably replied that whilst they can;t be sure what info you were given, your circumstances suggest a need for cover and therefore you would probably have taken it anyway.
You haven't said what your complaint reasons were or their reasons for rejection, so were are guessing a bit. But unless you can convince them that there is some actual wrongdoing, they are not going to just hand money over to you.0 -
I've just received a letter from BOS regarding PPI on 4 loans I didn't know I had (the PPI not the loans) The loans were linked to a BOS Preference credit card I had in 1999. I sent a letter to BOS asking if I had PPI on my card & they sent me 2 claim forms. I filled them out without a lot of detail as I couldn't really remember anything and didn't have any account details. 2 weeks ago they rang to go through my claim & this morning I have received a letter offering me £7,859.09! Result 😊0

A few weeks ago I did an SAR to see if my OH had PPI on two small loans he had in 2003 and 2006. He did so I used the template letter and a form that Halifax request. My OH said it would never pay out.....how wrong was he, 5 weeks later just over 3.5k awarded as compensation! Thank you!3 Children - 2004 :heart2: 2014 :heart2: 2017 :heart2:
