A relative of mine just submitted a claim to MBNA for PPI. The response was along the lines of "We have records of a phone call from when the loan was esablished. You agreed to PPI during the call, hence this claim has been rejected". The letter was actually a lot longer than that, but that's the essense of it. My relative was advised that there was a cooling off period, could cancel etc etc.
However, as this would be a significant amount of money I'm interested in whether there is still an avenue to claim or whether the fact that it was agreed to does invalidate the claim as the bank says. Any advice would be much appreciated - sorry if it's been covered in this thread already, but there are thousands of pages to read through!0 -
Called Barclaycard yesterday for an update on an old Goldfish card which they rejected last year and which I resubmitted to them...they are upholding my complaint!!
I started with 5 claims in August last year and so far:
MBNA upheld in Aug 2012 - very quick pay out!
Capital One upheld in Nov 2012
Barclaycard (Morgan Stanley) - gesture of goodwill paid Sept 2013 (letter breakdown showed all PPI and interest repaid)
Barclaycard (Goldfish) upheld Oct 2013.
Nat West - rejected claim in Oct 2012 and sent to FO, Awaiting response.
All in all not a bad result really, have said it before but the best approach to claiming is to start out with the attitude that you have nothing to lose except the price of a stamp and don't assume you will automatically receive a refund. Also, be prepared to wait, some people receive quicker payouts than others and this depends largely on individual cases. There is also the FO and although the wait can be lengthy...you still have nothing to lose! oh and also...DO NOT use a claims company..you can do all this yourself!!! CITICARD (CitiFinancial) Complaint Upheld
Just heard today from BarclayCard upholding a PPI complaint also - did not fill out questionnaire so was surprised how quickly this was agreed
MBNA (4 accounts) - 1 claim rejected though I shall challenge through Ombudsman as they have ignored the data I gave them on sick pay and PMI I had at the time as theystated I had no sick entitlement!!! Another rejected because I opted for the insurance (Again irrelevant - so will push to Ombudsman). Third account upheld by Ombudsman but subsequently rejected AGAIN by MBNA - wasn't sure they could do that.....Fourth awaiting feedback - MBNA seem to be very obstinate in their case reviews....
Another 2 Barclays claims awaited, Lloyds AMEX and LLoyds Loan and BOS Capital Bank loan. Also Marbles card being reviewed. £1.6K recovered on CITI and Barclays so far:j0 -
Forgot to ask the question in my previous update....anyone had any success with MINT PPI card reclaims as I have just received the usual brush-off...I assume FOS is the next step?0

Ask for a copy of the recording then listen to it and if your relative happily takes the PPI then game over....if it sounds as though they did not then go back to MBNA and dispute the rejection.0 -

I got the FOS letter on the 22nd August, got my letter from Barclays stating their offer on Monday 30th Sept. the FOS did say they had 8 weeks to write to me.
Should get the cheque within 4 weeks.

I have had success in a PPI claim.
Took out a loan from PC World to buy a laptop back in 2002, loan was through Household Bank, and being young and naive, didn't know a lot about the PPI stuff, so took it out.
Found all the statements about three months ago, so used the form on here, and copied all the statements and sent them off to see if I had a claim. Received the offer letter of £279 (I was only expecting something like £160), so took it and money has arrived in my current account today!
All the dealings were with HSBC, as they own Household Bank now.0 -

I'm pretty sure they can't reject a ruling by their regulator, have you spoken to the ombudsman?0 -
Hi All,
I just wanted to post a message of thanks. I was down to my last £100 when yesterday & today I received 10 cheques in the post from Halifax totalling £9832.16 for being mis-sold PPI on 8 loans & 3 Credit cards over the past 15 years. (another cheque for £420 is on it's way):j
I've had 2 rejections from Egg Card & Mint which I will take to the FOS & I'm still waiting to hear back from Cahoot & Virgin Money.
I wasn't going to put a claim in as I thought I wouldn't be entitled to anything & I also thought it would be a lot harder but it is well worth a 5-10 minute phone call & it's hassle free0
