    Not sure how anyone can prove something was mis-sold on a telephone/internet sale? any idea's welcome!
    As they have been found guilty of the whole thing, surely the proof game is with them.
    Re FOS, yeah no doubt we will end up there, however they are so far behind with cases that i will be a very old man by the time we get this sorted.

    You can't prove mis-selling in such instances. In this case you appear to have mis-bought.

    Guilt implies some crime has been committed and, certainly in your case, guilt or innocence has yet to be established.
    In law, he who asserts must prove. You are the complainant so you must provide evidence to support your complaint.

    Not only will a FOS referral take as long as eighteen months you are far from certain of a resolution in your favour, I'm afraid.

    I stopped my OH from going through a claims company (he was about to send back the forms - eeek) and persuaded him he could do it himself. Anyway, two claims from Virgin and Barclays are back (still waiting for 1) and both upheld! A total of £2,530!

    Not bad considering OH had no paperwork and very little info and he didn't do an SAR either. He's very happy and is paying for a holiday as a reward for saving him (so far) £750 from the clutches of that claims company.

    Shame I never ever took out PPI on the numerous loans and credit cards I've had over the years - the money would be fab now!

    Look at post 34283, I answered your question.
    You need to contact the banks and ask for a breakdown of all the calculations, they should do this as a matter of course though so ask the claims co to work for you, that is what you are paying them for.

    You need the workings out of this PPI to be able to accept the offers, have the company or the banks sent you these?.
    You have a contract with these so you have to pay, look at the other post I made and act on that.

    Regardless of whether you received the service you "expected" you have received the service you signed a legally binding contract for. You'll have to pay the £636 I'm afraid.

    You have a small avenue of escape if you can show that you told the Claims Company at the outset that you had outstanding debt with the Banks to whom they complained on your behalf. If this is the case, you need to complain that they should have warned you that no redress would likely come to you personally.

    I contacted a company out of a national newspaper BEFORE finding this site, and told them I had PPI on a credit card and loan and lots of charges on credit cards, I asked how long it would take and whether it would pay off existing debt, to which she replied (thankfully) "You're best doing it yourself because if you still owe the cc company they will take it back and you'll be charged by us, we don't really take on clients they still have a debt, it just wouldn't be fair"

    If you told them you had debt I think you might have a case, if you didn't, unfortunately you probably haven't.

    Can anyone add advice on a GOOD firm to use to reclaim PPI/ My situation is that I have tried doing this myself with martins templates but I am unsure on a LOT of closed credit card accounts and a couple of loans if I actually have ever had PPI on these.:eek: I have had some replies back, all varying in information but all are still none the clearer and are asking me for extra info, signatures (fair enough) etc and if I ring, they are then fobbing me off to another phone number. This is doing my head in :eek: because it is easy when you can SEE the PPI but if you don not know , then I am walking in the dark. I have decided a PPI Reclaim firm would be easier so need one that is trustworthy (and yes, I KNOW that will take 25%, I am past caring now). You may say that if I can't see it, then I have no claim but I still think things are hidden and some of these accounts go back a long way:(

    There's no point because they will ask you to do what you have been doing anyway.

    They will not look for whether you have had PI or not, they will ask you to do that, then they will fill in the same forms that you have, and send them off.

    If you use one, be prepared to do all the work.

    PPI on credit cards is not hidden, it's on every statement. PPI on a loan could be in with the monthly payment if it was sold as single premium. PPI cannot behidden in interest, this is a fairy story put about by claims companies becasuse they want your money. A lot of people are silly enough to pay them too.

    Thank you for the advice, it saves me another load of letters. Maybe I am wasting my time as if it is not showing up anywhere, then I probably never had this.
