Well after the FOS going in my favour twice with my ppi claim, and twice barclaycard rejecting it. there third rejection is a total shock.

first time FOS went in my favour as barclaycard didnt give any evidence for them to look at. (but rejected anyway)

second time FOS went in my favour as info barclays had sent wasnt clear enough to even work out if it was even my paperwork.
(rejected due to being postal form, plus ticked ppi boxes)
lies, it was in branch, and told couldnt have card, unless i had ppi with it.

now they come up with this out of the blue, "paperwork with tick marks in the ppi parts". and saying only i was involved in filling out the form, and no one from barclays helped/or informed me.
only issue i have is its "zoomed" in to only show this part of the page, but the mistake they made is the part above it says what job i was doing at time account was opened.
at the time i opened the account i wasnt doing the work this paperwork says i was doing.

but the job it says i was doing on this paperwork,is the job i was doing when i tried to open a "new" barclaycard credit card account after 2007 (over 10 years after i'd opened the one i'm claiming for) filled out a postal form, sent it off,but was rejected for it.
seems to me barclaycard have used the 2007 paperwork,"zoomed" in on the ppi ticked boxes, and sent that to the FOS as there proof of why they reject my claim.
i'm shocked,by the way barclaycard have treated me through out this claim,i thought nothing would surprise me, but this just proves what a sorry state this bank is in. good luck all ,you will need it,if this is the way they work.

Where does this leave you now? What is your next move, this is similar to my situation, except Barclays took all my infomation from my bank account, and applied for the card on my behalf, without my concent or knowledge. But tricked me to signing it. FOS are taking their side, as I can't proove it. They only looking at the signed agreement, but said I can take it to the ombudsman, as I have already had 2 assessments.

I am claiming PPI back for my brother on an account he had with HFC back in 1999. He only has 3 statements for this account but they clearly show that PPI was added every month. The statements show that @ 1999, his balance was £3,000 and PPI of £18 was added every month. Wrote to HFC who are stating that their initial search has brought up insufficient evidence. They are asking for an MPI - legal agreement (confirming the monthly rate of the PPI) but he doesnt have this and all available evidence of PPI payments made. I have sent them one statement but should I send the three? My brother didn't realise that PPI was added to his account. He has been in financial difficulties for years and just agreed to anything as he thought he would not get the funds. Any advice would be greatly accepted

    Hi All

Just a wee update, after Capital One rejecting my PPI Claim, which I sent to FOS, they called me last week to say they were not upholding my claim :( so thats the end of the road for that one.

They decided I was eligible for the policy

I was given a high level of cover for what I was paying, I think it worked out £0.69 for every £100

There was a third point but I don't have the paperwork to hand, I guess because I had ticked the box on the application saying I didn't want it then I thought I had a chance, he said because it was also sold over the telephone it was very hard to prove anything.

Don't let this put you off, I have had successes with a lot of other PPI claims, this is the first proper rejection.

Yes you can! I have just received notification from Santander that PPI including statutory interest totalling £1,583.16 on an old Alliance and Leicester loan I had between 2007 and 2009 is to be refunded to me.

Like you, I had no paperwork or account numbers to go with but was aware that the loan had had PPI on it. I printed my credit report using the free service provided by Noddle. This will help you identify key account details such as the last four digits of the account number, the dates between which the account was active, which lender the account was with and your address at the time of taking the loan. This together with your date of birth is sufficient for the lender to track the account and do the necessary for you.

All I did was use the MSE template letter and enclose a copy of the FOS questionnaire (completed as much as possible), together with a copy of the credit report extract. Happy days!

Great news for you ive just registered myself on noodle but it asnt given me any numbers. We are just going to write off to the creditors using the template letters requesting original agreements and see how it goes. Thanks for you tips

He's complaining about a credit card. If he bought this by post or online then his chances of a successful complaint are very slim, unless [and this goes for if he bought it in the bank] he can show he didn't need it, he could have paid the debt with alternative means of income besdies his job, it wouldn't have paid out because of a pre-exisiting illness or it wasn't suitable.

If you can't show it was missold, or come up with a provable explanation as to why it was missold, your complaint will fail.

Haivng PPI is not enough. You have to show it was missold.

To show he paid it, you need a representative sample of statements, which you either had to have [which you don't - photocpy the three and send them off...or --->] or which you could have aquired through a SAR [see front page sticky]
Because it's an old credit card, there may be no info left.
You need to send a SAR to see what info there is left. If nothing comes back, your complaint is over.

They won't provide agreements on closed accounts. For those i.e. closed , you need to send a SAR and £10.

Thank you, I will write to them, enclosing the three statements and see what they say. If they come back rejecting my brother's claim, I am thinking of printing off a claim form, filling this in and threatening them with Court action. HFC have been fined for misselling PPI and maybe this might work.
  • Hi all

I just called Lloyds TSB to find out my account number on a Graduate loan I had that i paid off in 2008. When I asked what the next steps were in terms of sending off the form on the Lloyds website etc and timeframes, she said I could do the claim over the phone. So I have. Slightly worried now that its all a bit too easy?! She's given me a reference number, but only briefly asked why I was making the claim-I told her I was told it was compulsory, that i wouldn't get a loan without it ( being young and foolish I completely believe this at the time). And that was it. Is this usual? And if they reject it - which I am now worried they will because I didn't get to go into enough detail, can I still go through the whole process?? any advice/thoughts??

You can't threaten them with court, it's not a legal matter.
You should have already filled in a complaint form or complained over the phone. Merely sending some statements without actually making a complaint does nothing.

If the complaint then comes back rejected, your next step os to send your complaint to the FOS, who will take up to 28 months to adjudicate.
