PPI Reclaiming successes and failures

  • A colleague in the the office courtesy of MSE received a substantial payment this week too.
  • My brother-in-law had taken out a loan with Northern Rock in January 2004, he sent a letter to Northern Rock to reclaim his PPi, however he has received a letter from Northern Rock stating that as section 77(3) of the Consumer Credit Act 1974 expressly exempts from such requests agreements under which "no sum is, or will or may become payable" and as the loan has been settled, the agreement falls within that exemption.

    The loan agreement states that there was payment protection of £3, 208.40.


    Can anyone please advise what my brother-in-law should do now?:mad:

    Did he request the agreement as the loan is closed?, had he the account number and put a claim in for mis sell, then the response from NR would have been different.

    They do not supply agreements where loans are settled, a claim for mis sell should be made.

    Should my brother-in-law just complete the consumer questionaire to reclaim his PPI from Northern Rock?
  • Hi Amersall, He complained to the bank, they gave the account numbers and said they had "no paperwork" relating to the loan. Took it to the ombudsman and they are investigating but the lady who was dealing with it was very unhelpful and has been complained about. Now a senior ombudsman is on the case, but long story short, my brother was declared bankrupt due to being dismissed from his job (won an unfair dismissal, bank refused to pay out PPI when he was dismissed and when his old employers settled out of court before the industrial tribuneral date). The Clydesdale were the main creditors who forced the bankruptcy, but it turns out, when it came to paying off creditors, the Clydesdale Bank were not listed......we are beginning to wonder if the PPI paid out the bank without his knowledge and hence all the denials of its existence.

    If he was made bankrupt, he's not entitled to complain about his PPI anyway because it's a pre-bankruptcy asset.

    Yes he should if he has reasons for mis sell and the account number.

    The Clydesdale would not have been able to make a claim on the PPI, there was no reason too, if Clydesdale forced the bankruptcy, they should have been listed as a creditor, I do not know a lot about bankruptcy but ask the FOS to clarify with the bank what debt they made the bankruptcy for, this may shed some light on this PPI.
    See what the FOS findings are, If a claim for mis sell was won, any redress would not go to your brother in law anyway, may be a good thing to let this go?.

    Yes, bankrupts cannot personally benefit from PPI redress-it goes to former creditors through the Official Receiver

    Just wanted to share my success to show how easy it can be to reclaim.
    I followed the guide and sent off a letter to Natwest asking for the details of my loans and any PPI payments. This cost me £2. I received a letter from them detailing account numbers, dates and PPI payments made on those accounts. I filled out the form that I downloaded from this website, sent it in to Natwest along with a copy of the letter I had previously received from the bank and around two weeks later I've got my result. £6375 was offered and according to the letter, this is a complete repayment of all PPI attached to these accounts. Result!
  • Hi Good Afternoon,

    I have been reading through the threads on here for a while now and recently put in a claim to Nationwide on behalf of mu Husband. He had 2 loans and a mortgage with Nationwide which were all paid off when we moved in together a few years ago. He was self employed at the time of taking the loans and mortgage on and had an existing personal insurance policy for self-employed people which would pay out £150.00 per day should he not be able to work.

    Nationwide have come back to us this week advising that they do not think the policies were missold as my Husband advised that he would not receive "sick pay" should he fall ill and that he had no health issues. They then go on to say that they believe he would have been able to claim under the policies as he would have been able to "wind up" his business and claim unemployment if he were ill!!!!! Really!

    I wonder if anyone could help at all - or if someone has had a similar situation - do I go straight to the FOS or do I write back replying to their letter and ask them to reconsider.

    Did the insurance he have, cover for sickness and did he have life insurance besides? if he did then I would write back and show that it was covered and the loans and Mortgage could be repaid in any event.
