Thank you. I didn't have life insurance and can't remember that far back on savings so would I need to provide evidence if I had any? Plus I thought if you were self employed it was a different scenario.

Self employment is sometimes covered, they said you had a need for the other cover though, you have to show that you did not, you can reject the reasons they give if you could have paid the card back should the worst happen.

I wonder if someone on here can help me, I am dealing with my brother's PPI on his behalf, having successfully been re-imbursed with my own and my mum's being paid out.

My brother had a loan with the Clydesdale Bank, he has the loan number but can not find any paperwork for the PPI, the advisor at the ombusdman who was dealing with it is worse than useless and a complaint has been made about her.

The Clydesdale Bank have now provided screen prints from aviva who they say were the PPI providers for their loans at the time, but although he can not find the PPI paperwork, my brother is adamant it was not aviva or norwich union as they were in 2002 who provided the insurance. Can anyone who had a clydesdale bank loan help with this? Thanks in advance.

Are you going the underwriter route with this due to the year and did you complain to Clydesdale first and what was the response?.

    Hi,
We've had some luck reclaiming PPI by using the templates on this site. We mail merged a number of companies and most stumped up apart from Capital One who have been very slippery!!
They fobbed us off with a very poor argument by sending us a copy of the example flow chart the sales staff are meant to use when selling PPI, however the documents stated the procedure wasn't in place until after they applied PPI to my account!!
It took 9 months to get this lame response from Capital One but as it was such a bad argument I referred the case to the Financial Ombudsman. The FO needed some extra info but once this was all complete they sent a letter saying their investigation will take up to a year due to the back log!!!
I hope the delay isn't that long but also hope all the waiting is worth it!

Has anyone else had any luck with Capital One?
Also, does anyone know if the year time frame the FO have advised, is on target? I'm hoping that this is the worse case & that I'll hear back sooner!

MBNA wouldn't uphold my complaint so I referred to the FOS.
The FOS have upheld my complaint and to date MBNA haven't responded to this within the time frame the FOS gave. The FOS are pushing MBNA to settle now. I have rung MBNA to check and they say I will hear in next couple of weeks! The FOS took approx 6 months to work through my case.
Good luck and just be patient

We have succesfully reclaimed PPI from HSBC on a loan that we had. We received just over £3,800 after just one letter and filling in the consumer questionaire.:j
  • My brother-in-law had taken out a loan with Northern Rock in January 2004, he sent a letter to Northern Rock to reclaim his PPi, however he has received a letter from Northern Rock stating that as section 77(3) of the Consumer Credit Act 1974 expressly exempts from such requests agreements under which "no sum is, or will or may become payable" and as the loan has been settled, the agreement falls within that exemption.

The loan agreement states that there was payment protection of £3, 208.40.

Can anyone please advise what my brother-in-law should do now?
  • Hi,

I have just received a cheque for £6,500 as a refund for PPI. I would never have had the courage to apply for this before - thank you so much MSE!

Did he request the agreement as the loan is closed?, had he the account number and put a claim in for mis sell, then the response from NR would have been different.

They do not supply agreements where loans are settled, a claim for mis sell should be made.

Received an offer today from Tesco Bank of £4429.00 for PPI misold on a loan taken out in 2006. Claim lodged on Dec 8. last year, offer made on Jan. 24. I did it myself and I did not use a claims company - furthermore it was all done on the 'phone. I have two more claims pending one with Barclaycard and the other with Yorkshire Visa. I have a feeling these might not be as straight forward as the aforementioned. I would advise anyone who who thinks they might have been missold PPI to give it a go, as its easy and there no need to use a claims company.
