So if someone was genuinely mis-sold, in person at a branch, but can't evidence it that means their complaint isn't valid? It strikes me that many people were mis-sold in this way, and frankly it's no surprise that there is little evidence to prove the injustice. Thousands of people were mis-sold, in person, and wilfully signed all the paperwork because they believed what they were told by the bank 'sales' person. How is it that according to some of the posts on here, many receive settlements with virtually no evidence, yet others who go into some detail have to jump through hoops. The lack of consistency is troubling to say the least......
Read my response to Phil-2244 and you may not feel so encouraged.

So are you saying I don't stand a chance?
  • No, but in the event of the Bank finding no such evidence then it will rely on sales scripts from the time and likely reject the complaint.

It's because the Banks don't actually detail why they uphold a given complaint. The Banks often find other faults not detailed in the original complaint or they may sometimes even decide to pay out without investigating at all (auto payout). As a result, many people who have written a complaint based on "hearsay" can be fooled into thinking their complaint has been upheld on that basis when it was something entirely different.

The only way to be certain of (eventual) success is to have valid and verifiable complaint reasons.

My question is how can one get the result they deserve when their valid complaint cannot be verified?
  • So are you saying I don't stand a chance?

Mate, I'm in no position to say, I'm not from a financial services background, it just seems you have as valid a complaint as anyone else has posted on here but haven't had the same result. As only us Brits would say, 'It's just not cricket!'.

So are you saying I don't stand a chance? I Don't understand why you are putting me off. Do u know all the legal reason as to why banks payout. Thought this website was for support. I believe I have given reason for a valid mis-sell just like many others who have been misold it the same way I was. In all due respect unless u work for ppi complaints I don't think u know why banks pay up!

You've already received your "full and final" rejection.

I advised you to go to FOS, but you want me to "support" you in writing back to the Bank to challenge their rejection?
I don't think "supporting" you in this is very constructive. Read the correct next complaint stage I linked to earlier:
    http://www.moneysavingexpert.com/reclaim/ppi-loan-insurance#step4

If you write back to the Bank you'll just delay joining the queue at FOS.

Sorry I'm new to this. By me asking if I don't stand a chance was aimed at moneyeptitude. Your encouraging me to continue. I thank you.

I've already explained that no one gets upheld on the basis of hearsay alone. The Bank's investigations often turn up faults not actually complained about. These are the complaints which are upheld even though the complainant won't ever know why.

You said you paid off the account in 2008 which means that they don't have to provide credit agreements for closed accounts.

If you're not sure if you had PPI try phoning them and asking, either that or issue them with a SAR.

What is the SAR stand for please.
  • Your encouraging me to continue. I thank you.
I encourage you to do whatever you're going to do anyway. Good luck!;)
