  • That's ok, I understood what you meant, makes sense even though I'd love to be able to appeal both claims. Thanks for the helpful advice :)
No problem, sorry to be the bearer of sad tidings!

That's ok, it's not your fault :) I'm just glad of some useful advice. I felt a wee bit disheartened when I received those letters today. Let's face it, the banks want us to give up at the first hurdle I had another credit card with MBNA that had PPI. I was sorely tempted to go through one of these claim handlers to save any hassle, but looking at lots of these posts there are many success stories, so onwards and upwards.

Your problem was that you used the weakest complaint possible with credit card PPI. Saying you didn't know you had it when it would have appeared on each and every monthly statement when your card had a balance is virtually guaranteed to fail.
    Look for better reasons if you complain to MBNA;

I genuinely did not know I had PPI with these cards until I was having a massive clearout of paperwork and came across a couple of old credit card statements... I was astonished. Another card years ago, as soon as I realised I was paying PPI I cancelled it straight away...goodness knows what that card was...I tend to switch cards to avoid paying any interest etc. Well my sensible hat has been on since about 2005...No PPI with any card taken out since then!! I'll complain to MBNA if I can come up with a valid reason.

That may well be true but, for the purposes of PPI complaint, it's a very weak argument.

To be sure of success, it has to have been mis-sold to you.

Providers didn't usually randomly apply it without permission-whatever you may have heard from Claims Companies -it wasn't a widespread occurrence

There are always exceptions of course;)

    How about the FSA?

''Some reasons why you may have been mis-sold PPI include.....the policy was added to your loan without your knowledge''

    http://www.fsa.gov.uk/consumerinformation/product_news/insurance/payment_protection_insurance_/claim-back-ppi

''It may have been suggested to you that you needed PPI to be approved for a loan or credit, or even had a policy added to the amount of your loan without your knowledge, increasing the balance you have to repay.''

It wasn't a widespread occurrence? It was common and in fact so common it was second and fourth in the FSA's list of common failings in PPI sales:

''The firm assumed the customer would want the payment protection policy from the outset (e.g. by automatically including it in a loan quotation)....... or made the sale without the customer’s explicit agreement to purchase the payment protection policy''

    http://www.fsa.gov.uk/pubs/policy/ps10_12.pdf

Is that clear enough for you?

The problem is that the FSA has no way of measuring that. The only thing it can go on is what people put in their complaints but seeing as every template letter going includes it means it doesnt really stack up as reliable.

We all know that the banks encouraged sales methods and some staff crossed the line. However, not all did. I would guess (as there is no way to prove it) that some firms systematically added it in the hope they would get away with it whilst others may have had no issues at all or had local issues rather than widespread.

A lot of the problem is that no-one has a clue how pre 2005 policies were sold as typically there is usually no supporting documentation or evidence to say one way or the other.

Have finally lost patience with Barclays and emailed CEO with the comedy of errors so far....
initial claim sent on 9th August rejected on the grounds no PPI on account, I reminded them I had sent a statement in with the complaint, turns out they had scanned my statement onto someones else's account. Was told it would be reopened, it wasn't, called again yes we will reopen it, called again not reopened, called again guess what (I know you are seeing a theme by now :rotfl:) not reopened, finally reopened on the 25th Oct. Called today for an update to be told a letter is in the post telling me that they have assigned someone to look at it and there is no timescale!!!

Have given CEO until close of business on Monday to reply to my email, if no reply then will presume failings in the company go right to the top!!!

Will keep you posted on any/if any reply

Well Tuesday PM and surprise surprise no reply, but have had a letter dated before I sent the email saying we understand you are unhappy about their recent response...are they having a laugh? Of course i am unhappy it has been a disaster from the start :(:(:(
  • Just phoned them and they are in receipt of the email and have promised a resolution by the 30th....not holding my breath
