After reading this website I called Santander 3 weeks ago & last week received a pay out on an Alliance & Leicester loan from 2004 of 1,250 (850 for ppi & the rest interest at 8%) Hurrah.

    On the same day I called Lloyds & claimed for 2 loans from 2004 & 2005, one an increase of the other. I have had numerous products from Lloyds over the years & are the only products I had ppi on. I raised the claim over the phone but they have both been refused (boo) as per below;

The consumer credit agreement shows that we required additional consent to confirm you wanted a PPI policy to be added to your loan. I am persuaded that this required a verbal explanation ensuring that you were made aware of what you were purchasing.

Now, I don't recall getting verbal confirmation of this or the ppi itself, one was applied for over the internet & one via branch, I vaguely recall going into branch & it taking hours & being given lots of forms to sign so wanted to know if I am in my right to request a copy of this CCA & also proof of their verbal explanation?

Also do you have advice on how to proceed from here before I start calling Lloyds for more info.

    Many thanks.:)

Well done with your amazingly quick success with Santander.
Re Lloyds, from my experience you have 2 choices. Either forget it, or refer it straight to the FOS. Unless you can present Lloyds with new verifiable evidence you are wasting time that could be spent in the FOS queue.
Your reasons for mis-sell seem flimsy at best to me(I,m sure the usual suspects will be on later to say more on that) but if you do decide to go down the FOS route you may need more verifiable reaons for mis-sell.
    Good luck.

Hi all I'm hoping for some help. After keeping a close eye on this forum and after the success of a colleague's PPI claims I decided to send out a few letters regarding previous loans and reasons I believe I was missold - work for the NHS therefore have very good employee benefits re: sickness, redundancy etc. I've been very lucky so far and had replies and payouts from both Santander and MBNA. Today I've received a phone call from Lloyds TSB who I logged complaints with regarding two loan accounts. They've asked if I can provide them with details of the sickness/redundancy cover which was available at the time I took out the loans (2004 and 2008). Problem is that the NHS Trust that I work for has since since merged with two other trusts and all policies etc have also been merged. I have told them I will discuss with HR but I'm really not hopeful of being able to track any policies down dating back that far. Has anyone had a similar experience with Lloyds and, if so, has lack of 'evidence' affected the outcome of your complaint? Any advice would be appreciated.

    Can anyone help at all??

my reason was no recollection of ppi & as I have had nurmerous products with Lloyds over the years without PPI it would seem unlikely that I would have agreed to it at the time.

I think I will give the guy a call & ask for his proof & then contact FOS.

    thanks
I don't respond to stupid so that's why I am ignoring you.

Only your HR department can help you with this one. If the Bank have written asking for evidence, you'll have to provide it if you want to be successful in your complaint.

The burden of proof is on the accuser (you), not the accused (the bank) so you have no right to demand proof of their defence of your accusation. In addition, the credit agreement is not available to you unless the loans are still being paid off.

This is the weakest complaint you can make, I'm afraid.
If you made the same complaint to Santander and were successful, then the Bank must have discovered different faults with the PPI sale during their investigation of your complaint.

As you've received a "full and final" response from Lloyds there is little to be gained from contacting them again now unless YOU have compelling new evidence in support of your claim.
If you remain dissatisfied you can go to FOS, but do be aware that the process currently takes up to eighteen months.
  • I've got £19000 back from PPI on 10 loans I've sent another 5 to the ombudsman I'm waiting on PPI from my mortgage and an MBNA credit card all using the template forms has cost me the price of some stamps
  • I eventually took the leap, and claimed on a Mortgage as well as a series of other PPIs. Seems that my Bank are so swamped, it takes 4 weeks just to 'mount' the complaint, and then they have the 8 week limit from then..

They sorted the mortgage to my benefit (apparently their records were lacking a few bits, so they could not say yes/no on being missold) and 3/4 of my other policies also to my benefit. Apparently there was a cooling off period in which I could have cancelled my PPI, so they upheld 1 policy..

They claim there will be no hard feelings as my business is appreciated.. etc.

I;m not in the fabled 64K payout league, and not in the 'average' 2.5K I see on these sodding adverts.. but any wolf that might have been sniffing, is now shooed off!

Rather spend a few minutes filling in a questionnaire than donate a fortune to some legal firm jumping on the new payout wagon..

I realise that many people have only flimsy justifications for why they feel they were missold PPI but I have to say that I find the following blanket rejection offered by some of the banks, completely inadequate. "The consumer credit agreement shows that we required additional consent to confirm you wanted a PPI policy to be added to your loan. I am persuaded that this required a verbal explanation ensuring that you were made aware of what you were purchasing."

I realise that the burden of proof is on the accuser (the customer) but I don't suspect that it would go down very well if I got stopped for doing 50mph in a 40mph zone and used the defence "The speed limit in this area is 40mph. Therefore I am persuaded that I would not have been travelling at more than 40mph. Thank you. Goodbye."

Even though I feel that the compensation I received from Lloyds was completely justified, I count myself lucky to have 'won', when I read some of the accounts of responses that some of the banks are providing these days. Good luck to you all in your legitimate claims.
