PPI Reclaiming successes and failures

  • Hi all, and especially Diane (if she’s still here) I have a problem, I have challenged all my PPI in the past for GF credit cards and loans etc and have won 4 out of 4, but tried to claim PPI for la redoute last week and have a response back declining it, basically.... she opened it up 10th Feb 2005, the month after the fos changed the laws (I believe). The account was opened and sold with PPI and added to the account on the 2nd June 2006. It states that the PPI product in question is NOT a "single Premium PPI policy but charged by reference to the monthly credit account balance. Blah Blah Blah
    Then it goes onto say, the claim that you have submitted has been made more than 6 years after the event complained of(i.e. feb/june 2006 and more than 3 years from the date on which you became aware, or ought reasonably to have become aware that you had cause for complaint, not only has the policy been clearly referred to on every account statement, but following an investigation by the fsa back in 2006, we wrote to certain policy holders including you in 2007 to ensure you were satisfied with the product and that it provided the required cover, our view is that your claim is time barred and is outside the jurisdiction of the financial ombudsman services.
    Sorry to go on, but some people like all the information.

    Seems like you no longer have a complaint. That letter they sent established a date when you would have become aware of the PPI and it's now well more than the three years allowed for you to reasonably become aware.
    Why didn't you complain back when you did the others?
  • Thx for the quick reply, We were unaware of the PPI on this one, she kept this one quiet, do i jst go to the FOS and see what they say or is it tough S**T???
  • Hi all

    I've been watching adverts for claims companies for missold PPI for months now and I decided to do it myself today. The trouble is I'm still a customer with the bank that I'm planning to claim against and apart from being owed what I think could amount to a lot of money, I've not had any trouble. Does anyone know if claiming will affect me as a customer in the future?

    That's why we took so long to claim. Eventually after the bank decided to start reducing our overdraft every month, we figured it was time to start being pro-active rather than sitting around hoping they'd write to us. Haven't had any problems since we put in the claim.

    got phone call this lloyds this morn about my loans claim very nice man said he would be crediting my account with £6277.01

    If you don't mind me asking, what grounds did you use to complain?

    ty if they still did mint mojos id buy 2 lol
    to be honest there wasnt 1 reason i used but many single premium we had other ways to pay the loan(which we proved at the time) and that we was told we wouldnt get the loan without it.
    just be honest with your reasons as everyones case is differant and no matter what reasons you give you cant be sure of a payout. good luck with your claim xx

    to be honest there wasnt 1 reason i used but many single premium we had other ways to pay the loan(which we proved at the time) and that we was told we wouldnt get the loan without it.
    just be honest with your reasons as everyones case is differant and no matter what reasons you give you cant be sure of a payout. good luck with your claim xx

    After reading this website I called Santander 3 weeks ago & last week received a pay out on an Alliance & Leicester loan from 2004 of 1,250 (850 for ppi & the rest interest at 8%) Hurrah.

    On the same day I called Lloyds & claimed for 2 loans from 2004 & 2005, one an increase of the other. I have had numerous products from Lloyds over the years & are the only products I had ppi on. I raised the claim over the phone but they have both been refused (boo) as per below;

    The consumer credit agreement shows that we required additional consent to confirm you wanted a PPI policy to be added to your loan. I am persuaded that this required a verbal explanation ensuring that you were made aware of what you were purchasing.

    Now, I don't recall getting verbal confirmation of this or the ppi itself, one was applied for over the internet & one via branch, I vaguely recall going into branch & it taking hours & being given lots of forms to sign so wanted to know if I am in my right to request a copy of this CCA & also proof of their verbal explanation?

    Also do you have advice on how to proceed from here before I start calling Lloyds for more info.

  • What reasons did you give for it being a mis sell?

    You can of course go to the ombudsman - but it might be worth seeing if there is anything else you can ofer as a reason for mis selling first and then going back to Lloyds?
