    has anyone had any problems with the Ombudsman returning claims incorrectly?

    I sent a few to them earlier this year and one has been sent back saying I didnt sign the documents - so these were returned to me - but when I checked the ones in the return envelope ALL were signed
    The second return was because they claim we must allow the lender a chance to resolve the issue - the lender was first contacted last July, then in Aug and again twice more before xmas.

    I've no idea what they are playing at but I'm expecting my other two complaints to be returned for pointless reasons too.

    I'm beginning to think they are that inundated they cant be bothered to read complaints correctly - I wrote to them back in Feb and we've only just got an actual reply now (though in their defence they did send acknowledgements within a couple of weeks.....advising of a 3 month wait for an ACTUAL response)

    any advice is greatly appriciated

    I followed Martin's advice to contact Tesco credit card. Their initial response was nonsense really and made no relation to my enquiry. I then used the Odbudsman form and within 12 weeks they refunded all my payments plus interest which came to £700.
    On the back of this I emailed Barclaycard and my claim was dealt within 24 hours! Thanks for the advice:j

    :rotfl:Hi just a quick update....have been battling with Santander over an old credit card but whilst looking for old cc statements found old bank statements with a few loans on so sent in questionnaire.

    I received a reply yesterday allowing for one of the loans - £670 which I am delighted with as every penny helps...two they could find no evidence for and have left it open for two weeks for further evidence. One they never addressed at all.

    I have copied all bank statements for three outstanding loans and sent them with the acceptance form yesterday. The loan they did not address has a copy of agreement showing ppi...so awaiting reply

    I have sent bank statements for cc and a copy from MBNA showing ppc on card when they took it over...prob chancing my arm but worth a try :cool:

    I would like to thank you all for your help and advice and if I could be cheeky and ask a question is critcal illness a separate issue from ppi?

    I have had a fab result with Natwest CC - a 'goodwill gesture' to the tune of just over 8K. I didn't hold out much hope as it was a non advised sale made by postal application. Imagine my delight on receiving the letter. And even better was that less than a week passed between sending the acceptance and them making payment. Well done Natwest!!

    I waited exactly the 8 weeks and phoned about my complaints just so that I knew one way or the other.

    Mine was for loans not credit card. At least if you phone them you can put your mind at rest!

    Hi there

    And welcome

    Sorry to hear about the rejection.

    Was the the final decision?
    Even if it is, you can still try by giving it another shot by giving them 14 days, and ask them to reconsider in that time as you've provided further info.
    If you hear nothing by then, or if they do not change the decision, then move on to the Financial ombudsman service (FOS).

    I would write back with any further you may have, and also ask them to provide the evidence of why they came to that decision if they were not there at the time you were sold the policy.

    Have you tried requesting for copies of paperwork/data for this account? it may help, but not guaranteed the details of the sale of the policy would be enclosed or not, however it may do.

    To request for a Subject Access Request (SAR), there is a template letter below, this is optional of course to request this, but as said above it may help.
    They have up to 40 calendar days to comply, and you enclose the one off payment of £10 cheque or postal order.
    Make sure you post by recorded delivery to ensure your letter is received, you can check Track and trace of the post office receipt number via Royal Mail website.

    Hi there

    Don't really know what to suggest really in regards of the unsigned complaint, but maybe you could have a word with them and tell them they incidentally returned the forms back to you that "were already signed" so baffled on where on the form where you did not sign.

    In regards of them stating that you must allow the bank/business to resolve at first, I take it you had already done this?
    As your aware, the bank must be send the complaint first by using the complaint form, and if they do not hold the complaint in your favour, you are able to complain to the FOS after that stage, once the final decision from the bank/business has been undertaken.

    If you've already done this, then I would for sure write back and make it clear that you have forwarded the complaint on to the FOS because the bank/business had rejected your complaint with a final decision.
    Did the bank/business send you a letter of the final decision?

    Hi everyone,
    Just got home from holiday to find a letter from LV stating my CPPI complaint upheld on an old credit card i had with Frizzell (now LV) about 10 years ago.
    Payment total being...
    Refund of the part of your monthly credit repayments relating to payment of the CPPI premium including any additional interest you was charged £2,362.93

    Compansation for loss of the amount your card would have been in credit by, from the date your account would have been in credit to date at the rate of 8% pa. in line with HMRC guidance we've already deducted the tax from this compensation payment and we'll include a tax certificate showing the gross and net amounts of interest with your payment £933.52

    TOTAL 3,296.45 to be paid in 28 days from signing and returning acceptance letter
    Is the total before tax? Anyway a nice letter to come home to.
    Still waiting for LTSB for their response on exactly the same thing.
