    Just a follow up to this received a letter today and the complaint I did not even make on the cc has been upheld for the amount of £5,074.53.chq in the post in 28 days I have £2000.00 outstanding will I get a chq for £3,074.53 or the full amount then I pay the outstanding balance?

    Not sure of the reason but it says ongoing balance was higher than it would have been if you paid the same payments without ppi??

    Thanks very much for your help this is a bit of a life changer so well happy been n debt far to long

    The PPI made the balance higher than it would have been without the PPI, this was why you were mis sold.
    They will send you the whole amount in the cheque, unless you have arrears, you can then pay the balance off when the cheque clears.

    If you did, this is Single Premium PPI and this is the reason for mis sell that you use on the questionnaire they send you, this was a loan on the loan paid to term end with interest, if you cancelled the PPI they would have given you a pro rata rebate of the PPI and the remaining PPI is still on the loan to term end.
    If you settled this loan early then, as above you, would have a pro rata rebate and you would have paid back the remaining PPI in with the settlement figure.

    wow getting a bit confusing:(. Think I just paid a monthly payment that included the PPI. Almost 100% sure that I didnt settle early on either loan, I think i just paid the instalmenst on each one....

    I sent my questionnaire off recorded delivery & they signed for it on 17th May but as of yet I've not had an acknowledge letter.

    Thank you for your reply. I rang the complaints line and was told they did not have telephone transcript , it was too long ago.
    On my letter they have stated
    'The insurance was added to your account because yoy chose to do so.However you had an opportunity to change your mind as a policy summary was mailed to you.We offer a 30 day no quibble.guaranttee.
    As to ascertaining personal information from the customer to determine their sutability for the product, this is a requirement of an advised sale under the FSA's ICOR regulations and our insurance sales have always been non advised.We have always given the customer details of the policy and let the customer make an educated decision if the policy is suitable for them@

    Surely they should have ascertained if the policy was suitable for me not mu suitability for the product? Also I do not have any policy documents that I can find(although we are talking since 1997 even though they state the insurance was upgraded in 1998 and 2003. This all sounds like a cop out to me.I have initially written my rejection letter but is there anything else you think I should add please. Many thanks for your help.

    Recieved a letter from Barclays got £749 to come they could not decide if I was miss sold the ppi and gave me the benifit of the doubt

    Evans and House of frazor say no from santandar as they done a telphone conversation and had 10 days to change my mind. Told them that the policy usless and adviser did not give me the correct info.

    any advise on how to fight it

    This is SP PPI, don't think that you will have paid a separate PPI payment, the year is a good indicator that this was SP PPI, use this as a reason when you fill the form in.

    Well done on the win :beer:
    Write back to Santander and reject the reasons they gave for not upholding and ask for the recording as you obviously did not take PPI when you applied for the cards, so why take it after a phone call?, put that something must have been said to you during this telephone call that made you go from not wanting the PPI initially,to then taking this product.
