PPI Reclaiming successes and failures

Hi
This is my first post and wonder if anyone can offer advise. I have three claims in for PPI. Barclaycard, MBNA and Santander (Debenhams Store Card). All discovered having read information on this site. The orginial letters were sent in April 2012. Still waiting for final decisions from MBNA and Santander.
Today received letter from Barclaycard stating they were unable to uphold my complaint for reasons that they have found no evidence of a mis sale. The original card was a Goldfish card which was taken over by Barclaycard. I noticed on the back of the statement an AXA payment protection premium.
I have been self employed since 1996 and have always made a point of not taking out PPi as it never offered relevant cover. I never had a conversation with anyone about PPI, it was never authorised, I have never received any policies of cover, I have seperate insurances for this sort of thing. Barclaycard acknowledge all these points but that they find "no evidence to suggest that this discussion did not take place" or that the they can find no reason to suggest that optionaality was not discussed with me or that they have not identified sufficient evidence to support my complaint that I did not request it or or receive policy cover. !!!!!
Barclaycard state that they will not enter into further correspondence on this matter but will co-operate fully with the FOS.
I am completely amazed. I am going to take it to the FOS but if they state they can find no evidence to support my claim, what evidence have they got? If the discussions had taken place (which they did not) they would not have sold it to me due to my circumstances... . They have given me no more information or evidence that they are right.. Is this just? Can I ask them to supply their evidence even though they state they will not correspond with me further?
Anyone help or offer advise, feel very deflated and conned...

My partner contacted a management firm which was more than willing to help with her claim, for a fee of 30% but, before taking up the offer she contacted her lender direct to find they were most helpful with her query, they have now made her an offer which she seems happy with, however, we've noticed that it's a figure somewhat less than the total of the premium paid. Does this perhaps mean that the lender is also taking a 30% cut of the money?0

Hi there
I take it that it was claimed by the claims management company, if you went ahead, and signed up to use one.
I would ask them to send you a detailed breakdown.
Well done though.:beer:The one and only "Dizzy Di"0 -

Hi
Yes write to ask if they will provide you with any concrete evidence, on why they rejected your complaint.
Have you also tried requesting for data by a subject access request (SAR)?
They should hold data on the accounts for at least the last 6 years, sometimes longer, and maybe someone will be enclosed to help you with your complaint.
If you've not done so, but want to request for the paperwork by SAR, they have up to 40 calendar days to comply, you enclose the one off payment of £10 cheque or postal order and there is a SAR template letter below.
If they have a data dept then send to them.
Good luck.

are littlewoods telling me the truth? Hiya i'm all new to this and hoping i may be able to get some help from someone!!
I've been looking into reclaiming my PPI and today emailed Littlewoods Cat for the account details which i used to hold with them early 2000, i paid off the account and closed it. What im wanting to know the reply they sent back to me states i did have a PPI ( which i wasn't aware of) and i'm just wondering is there nothing else i can do to reclaim this as they seem to state i can't. As i don't really know about this subject i'm hoping someone might !! Thanks ;-):rotfl:
Thank you for your email.
I have taken a look at your old account and found that a PPI variant named Extra Care 500 was active on the account between the dates 12/09/2001- 02/07/2002.
Extra Care 500 is an optional insurance that could help cover your catalogue payments if the Account Holder or a partner (if eligible) is made unemployed (aged between 18 to 65), signed off sick from work (aged between 18 to 65), is hospitalised (no age limits), is diagnosed with a critical illness (aged between 65 to 74) and it may also cover Life (between the ages of 18 to 75). This insurance may also cover most goods purchased on your account against loss, theft or accidental damage up to two years from the date of purchase.
The premiums are calculated at 1.46% of any outstanding balance (this will include items ordered then returned or goods purchased under our 'buy now pay later' terms).
As previously stated, this Insurance is optional and as requested your insurance has now been cancelled. Any cover provided by this product will cease with effect from 2nd July 2002. As the request to cancel has been received outside of the cooling off period, no refund of the premium charged will be made.
If we can be of any further assistance or you have any further comments or queries please do not hesitate to contact us. The direct line telephone number for Insurance enquiries, claims and cancellations is: 0844 811 1220.
Hi there
If you did not ask for it and did not want this insurance, I believe you can make a reclaim complaint with the reasons you have.
Tell them they were wrong to sell the insurance automatically and you wish them to refund this back to you.
Keep at them, good luck.;)The one and only "Dizzy Di"0 -

Myself (chain of 5 Loans), my partner (1 Loan) and my father (1 Loan) all put in our complaints at the same time (02.04.12), all had Single Premium PPI added. I rang the call centre on Tuesday to check on progress, to be told all complaints had been upheld. I then prompted my partner and Dad to do the same, and it was equally as good news for them too:T:T:T:T
They said letters were on their way detailing the offers, but are yet to be received. However, funds have been deposited direct into all our accounts today, just 2 days later:D
It's taken exactly 6 weeks and 3 days from start to finish. One phone call is all it took, so please don't use CMC's if you can avoid it!!!!!
Just over £10,600 has been refunded to my family so far, and we're still waiting on a few more decisions. Over the moon as you can imagine!
Keeping everything crossed for everyone waiting, and sending huge THANKS once again to amersall, moneyineptitude and all others who give out sound advice on the forums, aswell as Martin:money: & all at MSE for their amazing site.

No, they do not take a cut of redress, they pay back the PPI paid and the 8%.
Was this a Loan or Credit card, how much was the actual PPI amount and how long was this paid for?.
Do you have a breakdown of the redress paid? if you do then post up here and we can tell you if they have done this right.0
