PPI Reclaiming successes and failures

I've had a letter confirming MBNA have rejected my complaint and they have forwarded a copy of my application form. It was a paper form and now I see it I can remember that I used to get these personally addressed fliers through the post a lot and I filled one in and got the card. I can see that I have actually ticked for PPI and I have also ticked that I am self-employed.
I've been in telephone contact with MBNA and it turns out that they have not scanned onto the system a copy of a letter from HMRC confirming I have been self-employed since 1990 and they have agreed to reconsider the decision if I send them a copy of the letter, which I have done (their only e-mail address doesn't seem to be working so I've faxed it and I will post it as well).
But my question is: is it a mis-sell as I am self-employed and was at the time or is it not a mis-sell because I ticked the box even though I was self-employed?
I re-sent my HMRC letter to MBNA and today I received a letter saying they had reconsidered and upheld my complaint!
Reclaiming: Credit card PPI.
Provider: MBNA.
How much: Premiums paid: £4654.44
Associated interest: £3,282.11
8% interest: £3,444.52
Total: £11,381.07.
One questionnaire, one letter and a couple of phone calls.
I was self-employed throughout the whole period and I ticked the PPI box and I ticked on the form that I was self-employed. I had just moved into my first house and I had gone freelance and I was low on cash flow and I think I was worried about not being able to pay the debt. I can't actually work my thinking out now, it seems bizarre that I would pay nearly 5 grand for no reason.
I'm chuffed beyond belief as this will go a long way in our house to clearing our debts. I want to say thanks to everyone who posts on here as I really would not have had the guts to do it without reading other peoples' experiences and the helpful encouragement people give you when you need it.
Don't think about using a claims firm - if I can do it anyone can! :money::D:D0 -
I am still in shock today as I made 1 visit to my local bank and asked for a list of all my loans,cards etc I have had with them including my mortgage which had mortgagesure attached.
That was early march so I then rang the PPI line and gave all the account numbers and explained my husband was self employed and we were always led to believe that he was covered etc.
We had confirmation to say they had 28 days etc to respond and yesterday it was like winning the lottery as we had a total of £7094.54 coming back to us and this morning another one regarding our mortgagesure for £5357.95 less £1205.46 which was my claim sometime in the 90s when I was ill.
They said I will be either paid straight to my account and others say in the form of a cheque all to be done within 28 days.
I am so happy as this has been the toughest year ever regards money health etc and we really needed a break.
I know the 28 days will be longer but I dont care as long as we get it.
I dont have to do anything unless I dispute anything.

I started a claim for missold ppi on a barclays master loan. They added just over 2 k on the Front of a loan that ran for 5 years. I had no paperwork at all and as I've used a claims company in the past (never again) I did some detective work with Barclays and got all the account info. called the ppi line and started the process on march 13th. I received a letter shortly after this saying they will investigate. Blah blah. Anyway to cut a short story long I called today to get an update and the chap informed me that they have compleated the investigation and a letter was sent out to me 2 days ago. I asked if it had been upheld and he said that they cant give me any info over the phone....but....it is good news. (for me I hope)!...
No idea what I,ll get back but will let you know when I get the letter.
Fingers crossed.....keep going....don't take no for an answer if you have a genuine case for a miss sell...DONT use a claims company..0 -
Well I've had loans with Lloyds TSB from way back (Well 2005 anyway). Because I was never that clever with money the amount kept getting refinanced so my last loan was for £19,000 in 2009.
I originally thought with all this talk of PPI that I had just been stupid and hadn't properly checked what I was signing up to, and therefore I wasn't due any refund. But after paying more attention to MSE I realised that because it was all lumped into the loan, and it was never fully explained to me that I didn't have to take it out with them I decided that maybe its worth a bash.
I went through the Reclaim PPI sections on here and I prepared all the various questionnaires etc, but in the end I ended up phoning the Lloyds TSB PPI call centre and they filled in all the necessary details in a 10 minute phone call. I had a courtesy letter saying that they'd received my complaint, and that they'd reply within 8 weeks.
6 weeks later, I had a letter through the post saying that they were refunding me £6106.21 :j:j:j:j:j:j:j:j:j
I'm fairly happy with this offer, and I've accepted it, but I was wondering about possibly slightly sharp practice on their part. The letter was dated 26th April, and I received it but I didn't receive it till the 10th May. I checked my bank account, still with Lloyds TSB and the money had already been paid straight in. Would this have put me in a slightly difficult position if I'd decided not to accpet the offer? Could I have refused it if the money was already in my bank account.
Another thing that confuses me, I still have an active loan with about £4000 to pay off. My initial thought was right, lets pay off the loan. But then at the bottom of the letter there's a bit that states:
"Our Personal Loan Service Centre will send you a statement which will show you the payments that we have made to your loan account and will confirm the outstanding balance on your loan. Please allow 28 days for your loan account to fully reflect the payments"
This has slightly confused me so I called Lloyds and got passed around between PPI, then the Loan, then back to PPI. They all talked about the loan being restructured to account for the PPI payments, but they couldn't say whether or not that actually means that the balance of the loan will be reduced. Its all slightly annoying - Ideally I was thinking I'd pay off the loan straight away so that my next installment of £460 that would be due on the 20th of this month wouldn't be due, but now I'm thinking is it worth waiting to see what this new statement is worth, because if the loan balance is to be reduced I obviously don't want to pay Lloyds more than I have to! If I did make the payment, and I later got the statement saying the amount owed had been lowered, would I then be able to get it back?
Does anyone have any experience of this last point?

Had a letter today to say will be paying out on my complaint - going to be getting back £285.00 which is marvellous.
The letter says it will be credited to my BarclayCard and the deducted again to be credited to my bank account.
Has anyone else had to do this and how long did it take to get your money back?: :j
