    excellent never had any problems in the past i have just started with CCCS to manage my debts as i have just gone into arrears didnt want them to get out of hand so they are paying my debters i have never had this difficulty before really appreciate any advice as i need that money to increase my payments to the debts or to pay some off it makes me feel sick that they would pay off the 4000 i have left on the loan.
    One creditor cannot take preference over another as you are in a plan to pay back, the money could be spread over all the debts, the only way you will know is to ring them and find out, they may take the arrears that you owe them and give the remaining redress back to you, the bank is better placed to tell you what they are doing, we can only guess as to what they will do.

    The 8% comes to you regardless of the other redress, make sure you get this and you need to pay tax on this amount.

    My issue are:
    1) I have records which I had printed out at a Branch for me showing commencent dates for the Loans, and since each Loan was taken to service the other, I can also say, when the preceding Loan account closed. I also remember approximately how much each Loan was for.
    I have definitely never made any claim as I have never been out of work for the past 17years.
    I am rather baffled that they do not have records to show even how much I took out, when and for how long. Considering, the refund includes interest at 8% per annum, £1000 for each of the Loans would look like they are refunding just about £600 per Loan, and I definitely paid a lot more than this.
    My question is: If I hold out for more, are they likely to withdraw the offer?
    If I take it to the FOS, what are my chances of getting more just based on my recollection.
    I was planning to send a DSAR to them, but why would i send £10.00 to people who have said they do no longer have any detailed records....

    Has anyone recieved a similar letter from Lloyds TSB? How did they approach it?

    I will phone them next week to ask about the other 2 Loans they have not mentioned, plus the 2 Credit cards claims I also filed.

    Is £1000 per Loan a fair settlement because they have lost their memory (and I haven't)?
    As much as I believe I deserve a lot more compensation for the ppi, I wouldn't want the !!!!!!s to withdraw the £3000.

    You could try a Sar although this may not get the info you need, it is worth a try though.

    If you take this to FOS you will have to prove the ppi on the loans and that you made no claim on the ppi, if you do not have this info the FOS will agree with the bank.

    You could let the bank know that you are doing a Sar and would they give you time to get this before withdrawing the offer.

    It is not what you remember, it is showing proof of the ppi, the bank have no proof and neither do you, the statements you have showing loan taken out and closed do not show the ppi and this is what you are claiming was mis sold.

    It is a fair offer with no proof on either side of this ppi and also due to the years they were taken out.

    As this is a goodwill gesture they do not pay you the 8% so you will not pay tax on this, the whole £1000 is for redress for the loans only.

    Hi another newbie here :)

    I have sent a questionaire off to MBNA as had a credit card with Abbey since early 1990s and then it was transferred to MBNA. I noticed that I had a payment protection cover on my statements and never really thought about ppi...how stupid is that lol

    anyway I did not know what date it started as have no documents and believe me that is not like me I keep everything ...so contacted them and cancelled cover and was advised to send form and they would be able to tell.

    Rang MBNA yesterday and they said it would be ten working days to I get a reply and that I had taken the cover out on 2001. As I was working in civil service then and covered for sickness for a year and had a pre exisiting medical condition I would never agreed to this so dont know how this cover started

    sorry for being a bit long winded ....does this go too far back for them to consider a claim
  • hi im newbie to this i have just received today an offer £4824 with all the breakdown simlar to yours i have got a current loan open it says on the bottom on the first page that personal loan service centre will send you a statement which will show you the payments that we have made to your loan account and will confirm the outstanding balance of your loan do you have the same on your letter im concerned that they are using this to pay back all of the open loan

    Hi Ya, Yes i have the same information in my letter but on the next page its states they will send a cheque or pay it direct into my bank account. Im going to call them tomorrow just to confirm, I will let you know how i get on :):D
  • Just sent off my barclay rejection to the ombudsman,how long is the ombudsman taking these days to look into complaints? Is it still say as long as a yr? :-(

    Are you sure they mean that amount as a full total and not that of each loan?

    The reason why I say this is because 2 of mine were from the 90's where they no longer held details and I they were standard offers of £1,200, at first I thought that was the total for 2 of them and they confirmed by email, that was for each one, as the wording was not that clear at first.

    I would contact them just to double check.
