    Definately go for the reclaiming and yes that is correct, with your sister making them aware of her medical condition at the time, they should never have sold the policy, as its worthless to her.

    If you go directly on the lloyds link below, they have a reclaim questionnaire, its the same one as on here, but follow the details on the lloyds site and where to send as well.

    I would complete separate reclaim questionnaire for the loans and the credit card.
    You can of course keep to the same questionnaire for the 2 loans, but remember to enclose both account numbers, because the reasons are the same that is fine, unless you prefer to keep them all separately, but definately keep them separate from loan to credit card and keep copies.

    The terms of my PPI all though not with Lloyds states
    "We will not pay benefits if the disability results directly or indirectly from a pre existing condition or chronic condition" it goes on to say " This exclusion will not apply to a pre existing condition if you have been free from symptoms and have not consulted a doctor or received treatment for a 2 year period prior to your claim"

    Epilepsy never gives you 2 years off does it so I think PPI would have been useless in your sister's case. They would never have paid out :(

    I will say in my own experience the loan ppi was easier than that of the credit card ppi, because with credit card ppi, they may come back and say, even though not eligible due to the medical condition, "you would have still been protected for life cover, job solutions, hospitalisation etc", so I would be prepared for this and write in the complaint form, you do not agree you should be paying for PPI if it does not "fully protect me, and for this reason its worthless to me, I made the adviser aware of my pre medical condition at the time and this should have been taken into account".

    I would also tell them "As this is also an ongoing medical condition, this have been the cause of much absense through sickness, and if I were to make a claim, I am now aware I would not be eligible!.
    Tell them it was not sold in your best interest. (your sister).

    And of course anything else you can think of that may apply.

  • About 10 months ago I decided to put in a claim to my bank for misold PPI, to be honest I really wasn't sure if I had PPI or not. Using the template letters available on Martins site I first contacted the bank, recieved their reply, then escalated it to the Financial Ombudsmen. In this period of time, the banks were looking to take court action in an attempt to block such claims, then a few months ago the banks retracted their legal action, opening the way for compensation to be paid.

    At this time all I had done was send one letter and complete one form.

    I recieved a further letter from the Financial Ombudsman saying that my bank, First Direct, have upheld my claim and that I would recieve a formal offer in the next few weeks.

    This morning my letter arrived.

    Basically my bank are going to compensate me for, not only my current loan which finishes in 2 months time, but also my previous loans which I have taken out with them.

    In total the compensation offered is a staggering

    £23,000 !!

    As you can amagine, I am gobsmacked. Thanks to this website and based on a bit of a chance that I had PPI in the first instance, I am now £23,000 better off.

    My thanks to Martin for his excellant advice and help on this website, and for making the whole process uncomplicated.

    I have been reading the boards and stories for the last few weeks while considering my own options regarding PPI. Like many I didn't think the PPI issue affected me - but I got a letter from Halifax regarding their concerns over not explaining "exclusions and limitations" on their credit card repayment cover. Nice to see they care! I was quite shocked as I am covered through my current employment for sickness and long term absence and I did not require this. As of 4/8/11 my PPI complaint has started. BTW the repayment cover was added on during an activation call as I had opted out on the signing of T&Cs.

    I also have an unsecured loan with Halifax that I had declined to take PPI. I thought it would be wise to check all was well with it and after digging out the documents I found PPI on the loan. In my mind this is serious mis-selling. I had a conversation with a lady in sales back in September 2008 (when the loan was taken out) and I specificaly declined taking that out - even though a hard sell was attempted. I left that conversation with the clear knowledge I had opted out of PPI. I signed the T&Cs when a courier brought them round the next day.

    Yesterday (8/8/11) I started the process of a complaint regarding the PPI on the loan.

    Hi all,

    I have some good news to report! Checked my credit card online just now and have had the following refunds applied:

    Premium Refund - £885.82
    APR Refund - £511.68
    Rebate Refund - £71.07

    I started claim for this on 3/8/11 so resolved in and around the 10 week mark. The strange thing is I called Halifax yesterday to see if any progress had been made and was advised 23/11/11 as a timescale - absolutely over the moon today!

    I am still waiting on the loan claim which I started on the 8/8/11 and will keep you informed.

    I can't really put into words how happy this has made me and the shared stories here have helped me stay fully informed and stay positive.
