PPI Reclaiming successes and failures

Hi All
Just had to post on here as you were my inspiration. Myself and my wife took out a joint secured loan with FirstPlus back in 2004 settled the loan in 2006 by refinancing again with Firstplus plus extra funds. Settled this through a re-mortgage in 2008.
I wrote to Firstplus in 2009 saying I believed that I was missold PPI as I was not made aware it only covered the first named person on the policy even though it was a joint loan secured against a joint mortgage.
They wrote back and said they had investigated it and were satisfied that I was not missold the PPI. I wrote again after this year’s court ruling at the beginning of August 2011 using the template found on this website and investing in one first class stamp.
We got a letter yesterday they are upholding my claim and are sending us 2 cheques totalling
£10,628.39 :j:beer:
We are literally both in shock....
Anybody thinking of doing it and still not sure. DO IT NOW

Hi all,
I had a letter from lloyds tsb stating that they were not upholding my ppi claim on my credit card, in the letter it states that they have documentation and that i had 30 days to cancel the policy, It also states in the letter to contact the PPI dept if i want to discuss further, if they dont hear from me then will assume that he case is closed.
I have contacted the relevant dept - it took 55mins of waiting to final speak with someone who didnt have a clue what i was talking about, i finally managed to find out that they have got a signed policy doc - this is news to me as i have never received any policy details from lloyds and when i asked for a copy of this sign doc i was told that they would not be able to provide me with this.
Anyhow i have sent 2 letters and 3 e-mails to lloyds customer care insurance & the CEO asking for my case to looked at again as i feel that it has not been investigated correctly, basically i have been fobbed off. The inital 'not upholding letter' was not there final reply.
Has anyone else had similar problems with lloyds?0 -

Hello I have tried to claim PPI back from halifax, but they have rejected my claim
It states.... our records show that PPi was applied on your account at your request on 23 jan 2007. I enclose a copy of your application form. Please note this application was made online, the signature you provided was an electronic one.
During internet sales process you experienced, information about PPI appeared on a separate screen to your credit card application. It would of been clear from this separate screen that PPI was a distinct product from the credit card. In addition, you were offered an option to tick the box to purchase PPI. This option box would of made it clear to you that you could choose whether or not to purchase PPI and understood that it was optional when you did so.
At the time PPI was added to your account, you were eligible for cover. As you have not provided evidence that you had any other adequate means of protecting your repayments in the event of prolonged sickness/unemployment, I have reached the view, that given your circumstances, the PPI policy you purchased would of been beneficial to you. I have seen no evidence of anything that would of changed your decision to purchase PPI policy. On this basis I regret to advise you that I am unable to uphold your complaint, or issue a refund of the premiums paid to you.
We have now exhausted our complaint process therefore it is our final response on the matter.
I am sure that the CC application was done in my local Halifax branch, with the lady on the phone sorting it out, and I never signed anything because paperwork was being sent to me. However Halifax have a form showing a tick for PPI and also card alert household cover. I never requested this it was made clear at the time that I needed it in order to have the CC. Is there anything elae I can do to try and claim?

After hearing Martin on the radio discussing PPI reclaims, I considered it, then put it to the back of my mind. I have a history of using mortgage loans to clear credit card and overdraft debts (bad I know) and loans and insurances have been a part of my financial control process for years. Recently though I decided enough was enough and I reviewed my account, only to find I was paying over £160 a month in insurances. I went into meltdown and sent a letter to LTSB stating that I wanted to cancel all insurance policies with Scottish Widows, halt all direct debits to them too and furthermore I wish to reclaim PPI payment made since November 2008. There's a reason for this date:
Back in 2008 whilst drumming, I had a strange "turn" that initially was my left arm paralysing. It recovered after a couple of minutes and got going again and so i forgot all about it. The following day, my wife suggested I see my GP and on the Monday he arranged a CT scan for a week or so away. That night I experienced symptoms of a stroke, the hospital wouldn't admit me that night and I had a repeat episode the next day and then spent a week in hospital. The good news is they could find no evidence of a stroke and after a multitude of tests, they've decided that it was due to migraines (although the neurological consultant has left the case open). The reason for my PPI claim was based on the fact that I have an existing yet undiagnosed condition, with a medical history riddled with symptoms. my argument was that in the event of me making any claim, it is highly likely that they could quote "existing conditions" and not pay out.
The response from LTSB was brilliant, they asked to see my copies of the agreements I signed. I was able to find them and found three errors, firstly my wife's employment was wrong on her application, the second one had all my medical issues (that I had detailed fully to the advisor) condensed to "Numb Arm" in the condition box. This isn't a condition but a symptom. The third and probably most important one though was that on my application I had stated that I couldn't afford the cover that was being recommended to me and so I had to take a reduced level of cover.
They responded saying they would have a decision in 8 weeks with an update at 4 weeks. They did indeed update me at 4 weeks to say it was all in hand. Three days before the 8 weeks were up I received a letter telling me that Cheltenham and Gloucester agreed with my claim and would be paying £142 to put right their mis-seeling of PPI. I was confused at this as I was paying £160+ per month since 2008. I rang and it was explained to me that this was in settlement of PPI's sold to me by Cheltenham and Gloucester. The guy kindly said he would find out what was happening with the LTSB side of the claim. He rang me back after 10 minutes, explaining he'd resolved the problem and that LTSB were indeed dealing with the final part of my claim. He then calmly told me that they too agreed with my claim and to make the matter right, they would be paying me over eleven thousand pounds! He then broke the details down into the respecting PPI's that were being paid back to me ......... I was stunned. I've waited until today to post this as until the money made it into my bank account, I didn't want to tempt fate, but this afternoon my account had been credited with 75% of the money as they are paying it direct to my bank by the PPI amount not a lump sum.
For the first time in many years, we will celebrate my sons 21st birthday, daughters 18th birthday, and have Christmas whilst in credit with no credit cards or debt being carried into the new year!

They seem to reject CC ppi reclaims more so than loan PPI, basically they will come back and say, even if not covered for unemployment/sickness - you would still be protected for life cover and hospitalisation and job solutions, but when this happened ot me a few years ago, I told them straight that being a housewife with my childrens benefits only, I didnt think it was right that I should be paying for ppi as it did not "fully cover me" and it was worthless to me.
So they upheld on it afterwards.

Sorry to hear this and it seems like yet another standard fob off complaint.
If you can recall on it being sold directly and not online, you need to tell them the complaints team have not investigated your complaint properly and obviously overlooked your reasons, as the sale taken place directly and it was not an online purchase.
They can sometimes change a final rejection letter in your favour depending on what further reasons you may have, tell them your not happy with being rejected as a valued customer where you believe you are in your right to make a reclaim on the PPI with the reasons you have, even if they thought it was suitable for you it should have been made an option, so basically it was not sold in your best interest, and the staff who sold you the product was not experienced enough to sell the product - if it was discussed then you would have remembered and again if discussed and if the sales staff was experienced then they should have informed you it was optional.
Tell them if you were told this then you would not have opted for the policy, as you would have considered a cheaper option elsewhere, as you now understand you could have purchased a stand alone protection elsewhere, but you were not told this by the sales staff.
I would also ask that they send you written evidence on how they came to the decision of your complaint.
Ask them to let you know within 14 days, and tell them you will otherwise take this matter further with any evidence you have. If you hear nothing then move on to the FOS, and the same if they do not change the decision in your favour.
Hope this helps, but otherwise if your not sure how it was sold maybe a Subject Access Request (SAR) may help, there is a template letter below for this request, you enclose the one off £10 cheque or postal order, they have 40 calendar days to comply.

I am helping my sister claim on 2 loans and a credit card with Lloyds TSB. My sister has epilepsy and she told them about it when she took out her policy. Should they still have accepted it or is this a "pre-existing condition" meaning she could never claim? I would appreciate any advice.
