    QUOTE=di3004;47537841]Hiya

    It may be worth mentioning of your sister's condition to the FOS if not mentioned yet, as they may move this on quicker.

    I would also keep in touch with them regular as well, every 2-3 weeks to ask for an update, normally when the case has actually been passed on to the ombudsman they do normally write to let you know or even email.
    So it maybe worthwhile asking if they can please email to keep you upto-date on the complaint.

    Its difficult to predict a timescale because of the backlog, but on one of mine it was about 3 months it was passed from the adjudicator to the ombudsman, however it may have been quicker for some.

    Do contact them and ask them to keep you upto-date by email and explain your sister's current situation, health etc, good luck.;)

    hi Di,

    Thanks. I forgot to mention that her case was fast-tracked, since we explained to the adjudicator of the horrific living conditions the repayment of the loan had forced her into (she has to use her kettle and sink for her daily hygiene, since we cannot afford to buy her a new shower and have it installed. Cases are only fast tracked if a positive outcome would be particularly beneficial to a claimant in extremely difficult circumstances (or something like that) so my sister's disabilities, and only just living above the poverty line, allowed the case to be fast-tracked. I've also had conversations with the FSA about a seperate issue of my own, but did ask the likelihood of the Ombudsman agreeing with the adjudicator's decision. One guy said the two would definitely agree, whilst another said they were unable to comment. My fear is that winter is looming, and the past two winters here in the South East have been horrible. My sister has such courage as a disabled person, and does her best not to let her condition dictate her life. But when the cold weather arrives, I really don't know how she will cope.[/QUOTE]

    Hiya

    I am keeping everything crossed for you both and what a worry for you, I can understand.
    Hope you both hear something sooner rather than later.

    Just a suggestion, maybe you could try explaining the situation to your local MP as well, to maybe put in a good word and raise your concerns with him or her, maybe they will write a letter on your (sister's) behalf.

    Good luck and please keep us posted, cheers x;)

    Cheers x:beer:
    So does it work out better for you then? Assuming so, you'll have them by the short and curlies once more, well done Di.:D

  • Hi everyone, I'd just like to let you know that after following the advice and process here on MoneySaving Expert, Lloyds TSB yesterday sent me a letter telling me my claim had been successful.

    Quick background: Back in 2005 I was diagnosed with Diabetes and in the May of that year I carried out a substantial loan with Lloyds to consolidate an existing loan and a Credit Card. At the time I was sold the loan I wasn't asked about any pre-existing medical conditions and after reading the small print discovered that at no point would I have been able to activate the PPI if I'd needed to as the condition excluded me.

    So back at the beginning of June I logged onto here and followed the process of contacting Lloyds with a breakdown of my complaint and after an initial telephone call from them was told it would be eight weeks before they'd contact me. At the eight week point I'd heard nothing so I contacted them again and they informed me that it would be a further eight weeks because of the large number they were dealing with.

    Sure enough the day after the deadline, a letter arrived informing me that not only had I been successful in reclaiming PPI on the loan but also on two previous loans (even though I had only claimed against the last one I was sold).

    The result, with the interest etc, I am now £9,850 better off. The cheeky part in the letter stated that of course I would be subject to tax on the interest and would have to inform HMRC.... no real apology for them causing the situation in the first place. Anyway I won't complain....

    So I hope my story along with other successes on here will spur more people to claim back what they are owed..... especially those with medical conditions which would have excluded them from claiming PPI. I only had to contact Lloyds twice and didn't have to fight for a thing.... I hope others will find it as easy :)

    Hi Paulie,

    Well done on your win, sorry to hear of your diabetes.

    The tax part is an unfortunate part of this whole reclaim saga, you are only liable to tax on the 8% simple interest, some banks will pay the tax for you, others leave it to yourself.
    If you pay tax through your pay, just let your tax office know, they will adjust your tax code and inform your employer, downside to this is that they will work out how much you owe on the interest, adjust your code but when this is worked out it may be say £5 on average each week over the year, but they backdate the money due back to the beginning of the tax year, so you might find a lump sum gets taken at the start then it would work out at £5 for every week thats left of the tax year.
    This happened to my good lady when we were successful with Clydesdale Bank last month, the upside to all of this is the money you receive includes the money for the HMRC.

    If you pay tax by self assessment you'd have to include it on your SA form when it is submitted.

    Hope this helps:D
    Thanks to all the competition posters.

    Well done and Congratulations to all recent winners!
    :T:beer::rotfl:

    I received my letter in the post today from lloyds, 2 old loans from 16 years ago, they lacked details because of the age, and even though i know the first loan was £5000 over 5 years and monthly repayment at just over £111.18 a month and it was settled a year and a half on to take out a further loan with ppi, but nothing in concrete evidence.

    So even though the email received stated they have upheld these 2 old loan ppi complaints, due to lack of info these are offered on a standard offer of £1,200.00 for each one, so total in at £2,400.00 for the both.

    I think I will have to accept, yet with the first one being 16 years old, the interest would have been pretty high, but lack of concrete evidence does not help.

    Still I suppose at least its better than nothing and they could have refused on investigating - due to lack of evidence.:beer:

    Well done Di, I am so pleased for you. x

    Advice please

    We had a loan with black horse which we finished in 2002 I have the account no and I sent the missale questionnaire to them. They returned it saying they couldn't locate the old account. I called them and was told it wasn't one of there account no's when I know it was. I unfortunately have no paperwork details of the loan, where do I go from here? All I have is the account no.
