Basically it says after reviewing the sales call they are happy with the way it was sold and we were told it was optional. The fact that it only covers the first five years was explained and we agreed. Then was told to check the paper work.

I've been very stupid and didn't fill my questionnaire in properly. I realise now I didn't actually complain about it been a single premium PPI. I saw the £71 a month in PPI within the payment and presumed the PPI was monthly. I've learned a lot using this site and now know that bit was not monthly PPI but interest. :mad:
They must have laughed their heads off at my complaint.
Amersall wrote a few points down for me yesterday which I've saved to put in my letter. Also, Niggly is on the case now - well he was before I admitted to being thick!! Probably sacked me now!!!
It's so hard to write a letter of this type but looking on the bright side maybe it may go in my favour seeing as I obviously didn't understand the single premium - every cloud and all that!
I can see my letter being full of ' yeah buts' and loads of 'ands'
Good luck to you I will keep looking for your upheld next week

Ahhhh hun my heart goes out to you, I have just got my paperwork out and I did tick the single premium box.
My missale points were
we were not told the ppi was in effect another loan that was added to the original loan and was repayable over the loan term with interest.
we were not told that the ppi only actually covered us for five years, but the ppi would still be on the loan term end with interest.
we were not told that the ppi would be on the loan term to end with interest and the cashpack of the ppi would not include the interest that we had paid over the last five years.
Also rambled on a bit about that we didn't think we would get the loan if we did not have there ppi.
I don't know if my missale points will be good enough but unfortunately like you I have learn't an awful lot more from these wonderful people on here since I submitted my claim. Ahhh well I will have to just wait and see.

No you are not stupid, you are ignorant (or at least you were). - Rejecting a PPI complaint without first taking account of your regulator's rule DISP App 3.2.4G, "Where a complaint raises (expressly or otherwise) issues that may relate to the original sale or a subsequently rejected claim then, irrespective of the main focus of the complaint, the firm should pro-actively consider whether the issues relate to both the sale and the claim, and assess the complaint and determine redress accordingly";
- Rejecting a PPI complaint without first taking account of your regulator's rule DISP App 3.2.5G, "If, during the assessment of the complaint, the firm uncovers evidence of a breach or failing not raised in the complaint, the firm should consider those other aspects as if they were part of the complaint."
- Rejecting a PPI complaint without first taking account of your regulator's rule DISP App 3.2.6G, "The firm should take into account any information it already holds about the sale and consider other issues that may be relevant to the sale identified by the firm through other means, for example, the root cause analysis described in DISP App 3.4".
The "G" in these rules means "Guidance" but it is a bit like the Highway Code rules that say "should", rather than "must" ("R") is the equivalent of "must"). In other words you do not "have" to follow the rule but if somebody challenges you about it later, the onus is on you to show why your decision not to was reasonable.
That is the probable position that FOS will take. You will probably lose in the event that the firm can demonstrate that it was reasonable to disregard the guidance - but I think that is unlikely.
However, if they are so foolish as to ignore what the FSA has told you, I doubt your protestations to the firm will make it any wiser, so I think you need FOS to force the issue.0 -

This is my first post on here.....and it is because I'm getting frustrated by HSBC.
My OH and myself took out a loan in 2004 over 8 years and we now have 9 payments left of the loan and PPI was missold to us. After a huge amount of letters and complaints and finally getting a third party company involved (not ideal but we were becoming frustrated) by the lack of contact from HSBC. The FOS sent our third party a letter on the 05 August 2011 confirming that HSBC had finally acknowledged our complaint and would be making a good will gesture on the understanding that the PPI would be cancelled (with pleasure!!) - we had until the 19 August 2011 to action if not happy that this the case, we did nothing because were over the moon. OH contacted FOS end of August 2011 and was told that HSBC would be in touch with figures....no contact yet. Have tried to speak to HSBC which is absolutely ridiculous because left-hand/right-hand do not know what is happening and apparently department I need to speak to does not take calls (handy!). We are getting quite desperate to get this sorted because we are still having to pay £380.00 a month for loan and PPI and I finish work in 5 weeks to go on maternity leave and would really like this to be sorted. Can anyone else advise how long it took from FOS letter to when payment was actually made?0
